  1. My K-1 visa just arrived. I plan to enter the US on the 6th of February which means my K-1 90 days will run out on about the 5th of May. We plan to marry on the 28th of April which is exactly a week before my K-1 expires. Will this be enough time to file AOS?

Is there anything I can do before we marry to make sure the AOS is as well prepared as possible? Please let me know your thoughts, and what I can do to make this as flawless and as smooth as possible.

Please let me know exactly what I need to do for AOS. We had a lawyer for the beginning of this K-1 process which wasn't money well spent. We will do AOS ourselves but both feel a bit inexperienced so far.

Any help or guidance would be hugely appreciated.

    Thank you in advance :)

  2. AGH! now i realise the stupid mistake i've made!!! My Canadian Passport is registered under the K-1 visa anyway so it wouldn't make a difference. isn't it amazing that my lawyer forgot to mention this to me. I will not travel to Costa Rica now because all tix that aren't via the U.S.A are very expensive and I will lose the money for the ticket. But never mind! I will just meet him in LA instead! £450 down the drain :)

    Thanks for your advice!

  3. I'm meeting my fiance in Costa Rica after I recieve my K-1 (hopefully tomorrow morning). Then we will fly to Los Angeles together which will be my POE. However, I just booked a flight to Costa Rica from London and I have a 15 hour layover in Atlanta, GA. Will this be a problem? I don't plan to leave the airport. I also have dual citizenship with Canada so perhaps I can travel in to the US on that to avoid any confusion.

Please let me know if you think this'll be a problem, thanks in advance!

  4. Hi all.

This probably has been asked a thousand times. I want to know what I need to take with my to my K-1 visa interview that isnt stated on the us.gov website.

Do I need my fiances birth certificate?

I have my birth certificate in long version, where do I get a certified copy of it? ASAP! my interview is in 2 weeks!

His mum is our affadavit of support, do I need his tax information too? W-2's?

I am taking further proof of ongoing relationship too just for the hell of it.

I have 2 x police reports of all the places i've lived over 6 months.

But I am STILL nervous. I really don't want to get there unprepared.

I have a lawyer which ofcourse has been helpful but also difficult as I haven't 100% understood the process of this application and he sent me a very large package with all the affadavit of support completed and says I don't need to bring anything else. But still, I have butterflies.

    Please help settle me down!

    Thanks!

    :)

  5. They couldn't find your file, but still took your money!

Some people at the Embassy don't seem to know their a#s from their elbow at times. Give DOS a call and see if they have it in their system as being logged at the Embassy.

Well the US embassy emailed me back really fast and said my case no. was on file, and that my medical was logged, just not my packet 3 yet (which i sent next day delivery on the 22nd of Nov) and that it can take up to 3 weeks for all docs sent my mail to load onto the system.

and regarding my initial call to the embassy, they said it just takes a while for all the info to load onto the system that the people on the phone are using. And yes they did take my money money money! But I got a receipt emailed to me about 5 second later and the payment is valid for 12 months so its all ok.

    PHEW!!!!!!!!!!!!! and thank you!

  6. Hi all!

I called the US Embassy in London today to pay my MRV fee and they couldn't find my visa file from my case number or my full name!!!!!

Even though I received packet 3 from them at the beginning of November, they don't seem to have a record of it!

The lady on the phone told me this sometimes happens and for me to email the embassy which I have done. (She did take my $350 MRV fee anyway).

Has anyone else gone through this?????? Should I be worried?!

    Thanks in advance!!

  7. For the rights issue I certainly was extremely uncomfortable with what happened after 9/11. This rights issue was one of the major drivers to my applying for naturalization. In reality the only time you could have a problem is if convicted of a crime for which the sentence could be more than 1 year. I seem to recall having seen some reports that they would even add up different sentences and deport people.

There is no automatic custody. It's down to each state. Here in Washington it's assumed that joint custody will be granted unless someone petitions the court otherwise. At that point my atty said I'd need psychologist reports etc. Thankfully my divorce was a very low-key affair without disagreement.

This whole needing a letter is a farce, plain and simple.

I've been divorced from my daughter's mom for a number of years. I do have a letter because we both believe that the one thing we want less than to be married to each other is the government messing around in our business. We state in the letter that it covers all trips for a 12 month period.

    My experiences:

    1) Canada - have been crossing the border every 1-2 weeks for about 2 years. Maybe 25% of these crossings I have my daughter with me so that makes about 12-13 crossings. I've been asked for the letter twice. Once I had it and no problem. Once I didn't have it and the Canadian border guard told me I "really should have it" and let me pass.

    2) UK - Both myself and my daughter are dual nationals. The last flight we made back to London I asked British Airways if they needed something and they said they'd never heard of it. Of course, entering the UK we both use our UK passports.

    3) Mexico - We've crossed the San Ysidro/Tijuana border on foot. You go through one turnstile to leave the US. Go through another turnstile to enter Mexico. One customs shack with a random inspection in-between. No questions, no asking to see the letter.

    4) China - The consulate did ask for a letter, "but if I didn't have one that wouldn't be a problem".

These rules are just a way of punishing honest people. If I really wanted to abscond with my daughter it would be trivial. All it does is give people a false sense of security.

Thanks for this. My fiance is a travel writer so obviously there will be times when I take 'the kids' abroad to go and visit him. I guess I'll get my letter laminated!

  8. Oh my, I never even thought about that!! We don't have kids yet but hell yes they'll be going to England to my sister, brother-in-law and mother if anything should ever happen to the both of us!!!

My mum (I love her) is controlling and is only concerned about her welfare sadly. If anything tragic happened and it was my fiance's parents who got custody of our children I can tell you that they'd have a much more loving and healthy upbringing. Disloyal to say, but true!

  9. Once I'm married to my US fiance and we have children together in America, I have heard some alarming rumours about the lack of rights a non-citizen has. I know of a couple (wife English, husband American) who were having major problems with their marriage, but the wife wouldn't cut the chord with him because if she did, he would have custody of the children. Also whenever she tries to take the children out of the USA and he's not present, he has to write a letter allowing her to take them out.

My mother is now saying that she'll never speak to me again if I don't give birth to my children in the UK! So I think I'm definitely going to have them in the States ;)

This story makes me wonder at what rights a non-American citizen has when they're living permanently in America, not just concerning children but everything. Are we non citizens protected?

Where can I find this kind of information out?

    Thanks!

  10. Hi everyone! I am feeling in need of support. How are you coping with the waiting? I really miss my fiance!!! This whole waiting is killing me!

I saw that Vermont office is back on 5 months processing time- does that mean it won't take longer than 5 months for the NOA2?

I started exercising each day, helps me release stress...but still there are days like today when I feel like screaming! :(

I feel like no one from my family can understand me well, that's why I am writing here. After all we are all going through the same thing.

By the way I wanted to ask if someone had to obtain a police certificate from the US. Does it take long to get it?

I pray for all of us waiting that we will all get approved soon and fly as soon as we can to be with our loved ones!!!!!!!

Don't worry you'll be fine! Its quite an anti-climax when the NOA2 comes through. Until then, you must try to be patient but most of all, think about ALL the many things you have to be grateful for in your life. That always made me feel so much more positive and focusing on the positive things is the best pain killer!

You should also sign up for SMS and email notifications on the USCIS website. I signed my fiance (the american national) up to sms's and me to emails so we both got the notification at the same time.

    Good Luck :)

  11. Hi everyone!

I'm having my medical in London on Monday. I have (pre-historic looking) records of my Diptheria, Tetanus, Whooping Cough vaccines from when I was one, but there's no record of my Measles Mumps & Rubella and my family doctor doesn't seem to have them on file even though I had them (according to my mother).

I don't really want to have them again as I don't think thats so healthy so just asking if anyone else had to have them again in their medical because they didn't have proof? Or if there are any peeps from the UK who knows how to track down their lost vaccine records through their NHS number or something. Not quite sure how/if/why to do this.....

Please let me know if you can help!

    Thank you :)
