Thank you! Very helpful

I've done multiple board searches and can't seem to find any specific info regarding our situation. LPR married to USC will be filing N-400 under 3 year rule. To give a little backstory, LPR was a visa overstay who left the US, which triggered a 10 year ban. Waiver of inadmissibility was obtained and the 10 year ban was overcome. In order to obtain that waiver, LPR had to formally apply for a visa (which we knew would be denied) and then apply for a waiver (which was approved).
Question is this - on the N-400, Part 11 questions 33 and 34 state "have you ever been removed, excluded, or deported from the United States" and "have you ever been ordered removed, excluded, or deported from the US". How to answer this question in light of the previously given background information? LPR was never removed or deported or ordered to do those things, but was denied an immigrant visa due to previous overstay. That immigrant visa was then approved after waiver was obtained. Does that mean LPR was excluded? And if so, should waiver approval documentation and an explanation be included with N-400?
Many many thanks!

Good morning all! Happy news - approved on 1/25/16 and card is on the way.

Yes, same experience. We are DMV regulars. It's a very inefficient process that really doesn't make any sense. That sounds familiar doesn't it?
-
All that is needed is the NOA extension letter that extends your green card for one year while your I-751 is pending. We renewed driver's license and travelled internationally WITHOUT any passport stamp. No problems at all. But you do need to carry that letter combined with green card.
Just an FYI (I was not aware of this): She did point out however that I should get the stamp in my passport stating that my I-751 is pending, especially since I had to renew my driver's license and she told me it couldn't be done without the stamp (neither can travelling). I came back a couple of hours later with my passport to get my stamp and went straight to renew my license and had no problems.
-
Exact same thing happened to us, except there was no time to do an official reschedule since a) the notice arrived one week before the appointment and b) we were out of the country. So we went to the ASC as a walk-in as soon as we returned and were prepared to explain with passport stamps, itinerary etc. They didn't ask one single question and did the biometrics straight away. No problems.
-
Update: Biometrics successfully completed today 6/8/15
Just wanted to update you guys...biometrics notice arrived while we were out of the country (guessing somewhere around May 25) stating that the appointment was on June 2. No way we could make that appointment...will be taking the notice to the ACS today along with passport and trip itinerary to show what happened. Hoping they will do biometrics then and there...

NOA1 arrived today dated 4/14/15
-
Same for us! Hoping to see the NOA tomorrow or Sat. Good to see things are moving at VSC again.
VSC cashed our check today! No NOA yet, though...
Things are moving again =)
-
Same same same (sent on 4/10)! We are getting ready to go out of the country on vacation too...greencard won't expire by the time we return but we're worried that the biometrics will be scheduled during our vacation time
Take the dang money VSC! LOL
I have no words... I sent mine on 4/7. It's may now and our check still hasn't been cashed.
-
So it appears VSC is taking a very long nap right now...all these NOA1s seem to be coming from CSC.
2.5 weeks later and we still have heard nothing.
-
Lots of people waiting along with you...ours was received on the 13th and we have heard absolutely nothing.
How long does it seem to take to get NOA1 after their receipt of application? Ours arrived there on Sat April 18th, and I am starting to get concerned.....I thought the worry of USCIS was behind us :-(
-
I'm with you...sent ours 4/10/15 and they received 4/13/15. As of this morning (4/20), nothing in the mail and check has not been cashed. They are usually quicker than this...
Hello everyone,
I sent our package on 04/08/15, they received on 04/11/15 and as far as today I haven't gotten anything on the mail and the check hasn't been cashed yet.
Hopefully next week I will get some updates.
-
Package sent today 4/10/15 to VSC...awaiting NOA1!

Four statement per year seems like A LOT to me unless you are short on other evidence. We have tons of other evidence (wills, joint home ownership, joint auto ownership and insurance, child's birth certificate, medical insurance, 401K, own a business together etc.). We will send in one statement per year (since the time of our marriage). Statement dates and account owner names highlighted. That should be enough I hope.

Have been on vacation and not checking emails/case status...checked this morning and we are approved!! Finally!!!! The notice says approval was issued on July 3.
Smell ya later USCIS

I think you're on the right track here OZ. It is my opinion that people get confused when they call USCIS and they say your case is at the local office rather than the NBC. I suspect that all cases are technically routed to the local office whether they physically remain at NBC or not.
It would be nice if they were more transparent about the process. While it would be great to have the green card asap, the more concerning thing for us is that this elongated process delays ROC and citizenship. Very unfair.
I read this at an Immigration website. It was written by an Immigration Lawyer:
NBC Processing Times
NBC Processing Times is a bit of a misnomer in some cases, as NBC does not determine processing times for I-485 and N-400 applications, which constitute the majority of the NBC’s workload. NBC does not determine processing times for those case types because NBC does not conduct final adjudication of those cases–a USCIS Local Field Office does. So each Local USCIS Field Office determines processing times for Form I-485 and Form N-400 applications. For processing times on N-400 and I-485 applications, please check local USCIS Field Office processing times
NBC Workload and ProcedureThe NBC’s largest workload is Form I-485, Application to Register Permanent Residence or Adjust Status (the final step in the Green Card process for those who are not filing for Immigrant Visa Processing at a US Consulate overseas), and the Form N-400 Application for Naturalization. These two applications are estimated to reach well over a million cases in FY-2012.
In the Form I-485 process, an applicant must provide all initial evidence before s/he can be scheduled for interview at a local USCIS Field Office. If evidence is missing, the NBC will issue a Request for Evidence (RFE). An RFE places a hold on the I-485 application, as well as the associated applications filed with it (for example, Form I-130, Form I-765, Form I-131) until NBC receives the missing initial evidence. Missing evidence will not delay N-400 processing at the NBC. But if the missing evidence is not provided at the time of the N-400 naturalization interview in the local USCIS Field Office, the adjudication of the N-400 may be delayed, or the N-400 may be denied.
Contacting NBCIf you need to contact NBC regarding your case, please call the National Customer Service Center (NCSC) at 1-800-375-5283. The representative taking your call will send an electronic message to NBC that will be answered within 15 days. Expedite requests, for certain applications, are answered within 5 days.
---
My TakeFor what I have read, the no-interview applications sit at NBC until the field office gets around to it to complete the job or do the final adjudication. If you have not received an RFE, which happens shortly, such as within a month after submitting the package or have been designated for an interview, your best bet is that your stuff is at a nice dusty cabinet at NBC. Calling ain't going to make a difference, because everyone is being told the same thing, "Wait". There are folks here at VisaJourney who are at the 11 month waiting.
"NBC does not determine processing times for I-485 and N-400 applications, which constitute the majority of the NBC’s workload. NBC does not determine processing times for those case types because NBC does not conduct final adjudication of those cases–a USCIS Local Field Office does. So each Local USCIS Field Office determines processing times for Form I-485 " -
So all of our cases are at local offices? Impossible. That is a BS answer from the USCIS to buy more time. People who submitted long after September have already gotten their approvals through their local office (and yes I know times vary by office but that can't explain it all). Doesn't add up.
We called USCIS and submitted a service request. They said that if we did not receive the response in 15 days to call them. We did not so we called them. They informed us that the local offices are falling behind with processing cases. She thus suggested we give them 30 extra days to respond.
So,yes, they are definitely falling behind...not sure why that is happening though
-
Agrabs that is so unfortunate! Glad you are filing a complaint. I have heard of isolated instances of your experience before...and I remember someone suggesting to bring along with other travel documents a printout of USCIS's site showing the rules about the combo card. Too late now...but if others read this post it might help them avoid trouble. It is beyond ridiculous that such a step would even be necessary!
Had a really crummy experience traveling with the combo card - making me all that much more bitter about being past the 9month mark
-
Everyone who filed in September (except those who had interviews at the local office - different process) is in the same boat...I don't believe they have even started processing Sept. applications yet. In my opinion there is nothing to worry about...they are just incredibly slow (surprise!).
on Sept 21 2012 our packet was received...765, EAD, i485. We got the card for travel/work right on schedule and have heard nothing since. At the time everyone seemed to be saying it would take around 9 months. We are now less than two weeks from the 9 month mark. Starting to get a little worried. Why in the name of God does this take so long? We are married, living together, joint bank accounts, etc, etc. We are a normal, legit married couple. At what point do we start to worry? Anything I should be doing now or just keep waiting? It really is absurd that this takes so long. Any advice other than keep waiting? Thanks and good luck to everyone!
-
Agreed. I don't think a phone call is going to get you what you want unfortunately. I think the Tier 2 person is just going to tell you that you need a new I-693. It's unfair, and will be pricey, but that is what will get you your GC most quickly.
Same thing happened to another person in Philly.
After 9 months of waiting, they got an RFE for medical.
To be safe, do what that person did, they did a brand new I-693 and all. GC approved, within 5 days after USCIS received the RFE paperwork.
I have a feeling it is going to happen to us too. Everything will be expired and we will have to cough up the money to get all done.
-
Add us to the list. Same letter (email), same wording in response to service request from March 23.
..I got same letter ..same text ..It was a reply on my service request 05MAR. So now I can do nothing just wait and see what will happen. Hope it was only ''go-away'' letter.

Interesting...we are at the same local office but our "in line" date was 8/22. Received interview letter on 10/2. Sounds like they might "batch" groups of petitioners.
