  1. Hi everyone, a newbie here. I came in as an International Student and currently is under my 2nd H1B (which will be expired on Aug 12, 2012). I met my wife (USC) in Oct 2010 and got married in May 2011. I sent my AOS and I-130 on June 28th and received by the USCIS Chicago lockbock on July 1st. So I am in this July 2011 Filers thread.

    I received a text on 7/7 and my checks were cashed on that date as well. Then I got my I-797 for I-485 and I-130 on 7/11. However, up until now I haven't gotten my biometric. I keep checking my status and it still the same (initial review for both). I guess I should wait for a few more days before calling then? What would you all suggest?

    On other note, would you recommend me getting an AP or should I apply for interview for H1-B stamp (my H1-B has never been stamp because I have not been out of the country)?

    Hi! I'm surprised how ow dates are so close,I Sent my AOS on June 25th and was received by Chicago lockbox on June 27th.I recived the Email on July 1st and checks were cashed that same day.I got my NOA in the mail on 7/05 and like you I haven't gotten my biometrics letter either,my status has also not changed since then.

    I'll wait until 08/05 since will be 1 month from when I got my NOA in the mail and my husband will call them,hopefully I will get the letter in the mail before the 5th.

    About your AP do you plan going out of the country while the AOS is pending? if yes I think you should get it,if not don't worry about it since when you receive your green card there will be no no need for it.

  2. I received my NOAs for AOS, EAD, and AP on June 25th and have not heard anything since, no biometric appointment, no updates on our case on the USCIS website. I see the July filers are now starting to get their biometric appointment letters. I am mostly concerned with getting the EAD approved. The website for my local office says it does not service EAD applications, this is done at the service centers or the national benefits center. In that case is it not a first come, first serve kind of processing method? Does anyone know if there is a way for me to contact the service center or national benefits center to check on our application? Are there other June filers who are also waiting on their biometric letter? Any info anyone has is greatly appreciated!

    I received My NOA in the mail On July 5th(dated June 27th) and I do not have my Bio letter neither nor updates,kinda getting impatient,I know how you feel,and I'm also waiting for the EAD to to get things done.

    Anyways I think you should try to contact the customer service number that they give on the case status(1-800-375-5283).My husband will be calling them on the 5th if the letter has not arrived by then.

    Which office you application is being processed at? where is you local office?

  3. My Priority date is June 27th,but I only received my NOA on July 5th,so I think I'm closer to be a July filler than June.

    I still haven't got my biometrics letter.

W-2's are absolutely not required if you are using tax transcripts from the IRS, and absolutely are required if you are sending copies of your returns--why not just do it the easy way and use the transcripts--this is one of the easiest things you can do, and yet seems like so many people are doomed to do it the hard way !!

    Yes,I totally agree with you I don't understand why so many people keep trying to do the hard way,IMO.On the instructions for the affidavit of support clearly states

    that if you have a tax transcript from the IRS(which can be obtained very easily and delivered by mail in a few days)you DO NOT need W-2's or 1099 at all,since the transcript comes with all the information they need and actually proves that you filled,since has a unique tracking number.

    Anyways just send the transcript for the most recent year and don't worry about putting together a bunch o papers

  5. Yes I do pay taxes since 2008 and no I did not claim to be a USC to get a job I simply used my temporary Driver's licence(now long expired) and

    my ITIN document,I been with the same employer since then and filled my taxes for the years of 2008,2009 and 2010.

    One more question,Am I suppose to include my tax transcript too?Because from what I understand they only consider my husband's taxes right?

  6. I'm about to send my AOS envelope and I want to make sure I'm not missing anything.

    I came on a B2 visa in 2007 and I'm currently married with a USC for 4 months.

    That's what I'll include:

    - I-130 form

    -USC Birth Certificate

    -Certified copy of marriage certificate

    -copies of joint credit cards

    -copy of joint bank account

    -Lease agreement with both of our names listed on

    -Health/Dental insurance copy

    -Affidavit from USC Father about marriage

    -Biographic information form with 1 photo for each one

    -I-485

    -2 identical photographs

    -Copy of foreigner birth certificate

    -Certified translation of foreigner birth cert

    -Form I-765 with 2 identical Photos

    -Sealed envelope with form I-693

    -Form I-864

    -Original Tax transcript for the most recent tax year(2010)

    -Employment letter for each job of USC

    Each of the forms will be submitted with the correct fees and with cover letter,I still not sure to put my unauthorized employment on the biographic info or not.

    Any suggestions on opinions on what I'm sending will be greatly appreciated.

  7. Yep I was surprised too whenever she advised me to "omit" the employment from the forms,I even said "wouldn't this be lying then?"

    and she said that they weren't concerned about my employment or taxes,and would be easier to just don't put anything on it and say that

    my occupation was homemaker on the I-485.

    In my head I was still thinking that this would be lying,and decided that I would do my paperwork myself since they were charging $950 just to

    file the paperwork that has pretty much most of the instructions on the USCIS website.

    She also gave some misinformation about what to file with the affidavit of support,saying that only the original tax transcript ordered from the IRS

    wouldn't be enough,that I also needed all w-2's and 1099 plus an employment letter from both of my husband's employers.Which I do know that is not necessary

    since it clearly says on the instructions for the I-864 that if you have a transcript you don't need to send in the w-2's or 1099's and if you're above 125%

    of the poverty line with your tax transcripts,that alone will be enough.

    Anyways,so you think that even though I worked w/o authorization would be better to be truthful and put this info on the forms and would still be approved?

    I'm about to send my AOS package(I-130,I-485,I-765,G-325A and I-864) and have a question stuck on my head about the biographic information on the

    G-325A.

    I came to the USA on a B-2 Tourist visa in Dec 2007 and since Aug 2008 worked and paid taxes with my ITIN number,which I do know,that does NOT authorize me

    to work here legally.I did not know then,since friends told me that I could work if I applied for one.

    On May 2009 I met my wonderful husband and we started dating,got engaged on Jan 2011 and had our wedding at the beach on April 2011.

    Anyways I thought since I've overstayed and worked without authorization I could not adjust my status in the U.S but my husband suggested making

    an appointment with Catholic Charities here in Pensacola,FL.We went to the appointment and the lady was very helpful and said that I still qualify

    for AOS since I'm married to a U.S Citizen,she also told us to do not mention my previous unauthorized employment on the form G-325A.

    But I'm very concerned about not mentioning it,because I feel that I would be lying and I'm pretty sure the USICS will find out such information.

    Please is there anyone who has passed through the same situation?what should I do?not put my employment info or put it on the form?
