Ok I'm a 100% sure that your lawyer filled your Form Wrong, here is how's suppose to be:
Part 5 sponsor's household size
21.Your household size Do not count anyone twice
Persons you are sponsoring in this affidavit
a.Enter the number you entered in line 10: 0 1
Persons NOT sponsored in this affidavit
B.Yourself 1
C.if you are currently married enter 1 for your spouse 0 0 NOT R or 01 as you already been counted aboveThis is for cases when people are sponsoring someone other than their spouses and their spouses are not the beneficiary.
D.If you have dependent children enter the number here 02
e. If you have any other dependents, enter the number here. 00(left in blank on mine)
f.If you have sponsored any other persons on an I-864 or I-864 EZ
who are now lawful permanent residents, enter the number here. 0 0 ( on mine I actually left in blank)
G.OPTIONAL: If you have siblings, parents, or adult children with
the same principal residence who are combining their income
with yours by submitting Form I-864A, enter the number here 0 0 (blank)
h. Add together lines and enter the number here. Household Size: 0 4
I really don't have suggestions on how to fix the issue, but If I were you I would send my own corrected answer so your case won't be delayed any longer by another RFE.
I have filled my AOS and helped my sister with hers and neither of them got an RFE,I filled both of them with 00 on that section.I really have no idea how your lawyer came up with an R and in all honesty I would definitively get rid of him.
I had an student visa screwed up in the past by a lawyer and I know how frustrating it is,learned the lesson and filled AOS by myself.
Anyways I hope I helped you with this info, good luck and wish everything gets sorted out.

thank you for the answers.
Do any of you know if the airlines in Brazil will accept an american marriage license as proof of a name change?
-
Hi I'll be traveling to brasil next week and I'm very worried about the passport name not matching the Green Card or Ticket,
The name on my passport is my maiden name and since i live 10 hours from a Brazilian consulate I could not change in time for this trip,Both the Green card and ticket names are my married name.
Any Brazilian girls have been to the same situation? will i have any problems coming back to the USA?
I"ll be flying with AA.And I'm worried that they will not let me out of brazil.
Thank you

I Know that this question might have been asked a million times on this forum but I would like to ask anyways stating my specific circumstances.
I'll be traveling to Brazil on March 6th and my flight is booked with American Airlines, the problem is My reservation is under my married name just like on the Permanent resident card and Drivers license but my Brazilian passport still has my Maiden name om it and it is extremely difficult to change with the Brazilian consulate since they don't recognize an American Marriage licence as a Name change document, the only way to have it changed would be to both me and my husband to go to Miami(we live about 10 from Miami) and get a Brazilian marriage licence then have the name changed on the passport.
Anyways did any of you have any experience with AA travel and name differences, should I just bring the marriage licence and explain that is not possible to change my name on the passport, will i be able to fly?
Thank you.

Since you have not done you biometrics yet would be easier to bring your marriage license to the appt and they'll fill the paperwork with your married name, that's how i did it,since most SS offices won't issue you a ss card in a name different from your Immigration documents, neither the DMV so you would save yourself some time by bringing your marriage license to the bio appt it just takes a second, the lady just looked at mine and check the paper they tell u to fill out and that was it.
good luck

Congrats!!!
They did not take my I-94 either, they only took my EAD card,as for the passport they could not have legally taken yours since you're still a citizen of u home country.

Greetings and congratulations to everyone who completed their AOS!
I was wondering about mine... When I look at my update online (USCIS website) it says they received my I-485 on July 12. I received a letter informing their transferred it to National Benefits Center on July 22. I received my EAD/AP combo card but haven't heard anything about my case being transferred to my local USCIS office... is this normal procedure? Was your ever transferred again after NBC?
Thank you for your replies
I think is normal,I did not get any message about being transferred to my local office.

Same here, we finally had the bio appointment last Monday, same day Card production ordered.
We already received the card yesterday (7 days after appointment!)
Now waiting for the interview letter.
That's great!!! I guess they are trying to make it up for it,hopefully my card will take only 7 days as well:)
Good luck with your interview,I think i'll be getting mine for the beginning of November if things continue to go at this pace.
Where you'll be going for the interview?

Went to the biometrics appt today finally, the people at the New Orleans office were very helpful. Then I got home and my case was updated to
card production ordered,I've never heard anybody saying that you could get the card ordered in the same day as the bio appt,I guess they try to make it up
for the super slow start.
happy that I'll drive again soon.

Hello July 2011 Filers!
I'm still waiting for my Biometrics appointment letter! Check my timeline. I already called USCIS, they put a service request, and they told me to wait 30 days...
Yes, Florida must be really busy.
I feel you,I been waiting for almost 75 days now,at this point I'm so frustrated that I don't care anymore.I called them I put a service request and they said the same thing, then a couple days ago I received a letter simply saying to keep on waiting since the needed "slots" to schedule an appt.
Anyways the only thing I'm going to do is try to expedite through our congressman office once I'm done with biometrics.
Good luck to all "Floridians" that still waiting!
-
Our biometric appoinment letter finally arrived yesterday. The appointment is for 9/19 ... that is 3 months after they received our application - wow
Maybe it's just Florida taking so long?
Congrats!!!...you must be happy after all this wait.I'm thinking offices must be really backed up down here!!!
I still waiting for mine, been 2 months since they received my application, hopefully my bio letter won't take 1 more month to arrive.
-
just give them a call tomorrow dont wait for the 27th it s already 30 days plus from 7/05
my spouse call them today On the phone,a lady asked for the receipt number so gave her the receipt number for the I485 she took some information like phone number, address, email and she gives us a ref number and told us to call after 30 days if we didnt receive anything, well lets hope something comes in the mail next week
Thank you very much for your help "need Patience",I just read your post and gave a try calling again and this time like u said the lady was very helpful and took
a bunch of information and gave me a ref number and told to call if we didn't receive anything, and she said we did the right thing by calling again since been more than 50 days since the NOA date.
Anyways hopefully we both will receive a surprise in the mail soon.Good luck to you guys.
-
i call them yesterday asking about biometric appointment and a lady told me that i have too call back tomorrow after 30 days
:bonk:
Pretty much what they told us....not very helpful will be 2 months of wait on the 27th.
Good luck

I am very close enough to my Field Office so I made an infopass today and went to ask them where the heck is my biometrics letter (I know, I'm not very patient). It went well, they were on time and the lady was able to tell me that I just got put in the queue yesterday but that there are overbooked at my field office and as a result, while I'm in the queue, a letter hasn't yet been issued since there are no slots available
Well, at least now, I know not to look at the mail box like a psycho everyday lol My husband was also kinda relieved because he admitted to obsessing over the the mail all day at work, hoping today was the day the biometrics letter would come and we could go out to celebrate the letter coming in lol
Poor thing ! I'm just lucky I have such a supportive husband
I'm sharing this so all of the others who haven't received the infamous biometrics letter can know that perhaps you are also at a busy field office and the line is long.
Patience, patience, patience. As Jerry Seinfeld would say, Serenity now, Insanity later!
I wish I lived close enough to make an info pass to know what a heck is going on with mine, but oh well, got keep on waiting,at least it's kinda comforting to know that maybe the same thing its happening to mine, since the New Orleans office its late too.
-
Awesome,how was it?
-
Congrats!!!! and good luck with your new job and interview!!
-
Opened the mail today and.....NOTHING again.
very very irritated with this wait.
hopefully all of us who still waiting will receive something soon
-
I still don't have mine either and my NOA arrived on July 5th,I know the time you wait varies depending on your local office but I'm definitively getting
paranoid and irritated about. My hubby called on August 7th,and a very NOT helpful lady told him that we just need to keep waiting, and she coulf not do anything about it.
Hopefully I'll see in the mail soon, good luck to all that like me still waiting

I would suggest that you order your tax transcripts from the IRS website, When I filled my AOS we did not submit paychecks or W2's we only sent the tax transcripts from me and my husband, our household is 2 and we made around 32,000(25,000 hubby and 7,000 me) that year and was just fine.
Sorry for not answering in Spanish,I can read it pretty well but can't really write.
