  1. we are tryn to email the london embassy, every time we do they send the 'auto reject email' to us, and hubby cant call the number to get the 'code' to email because its a premium number, this sucks lol nvc need to haul #### with this rfe ####### now, grr, bad day

He will have to call the premium number if he wants to email them with a code. You need the days unique code otherwise it will probably be rejected when sent. See if he can use someone else phone if he only has a mobile. After you have phoned, there is a number you can call to grumble about the charges, and sometimes they will return them to you.

  2. Ok so we have sent in both RFEs, ones been processed already an the other we expect a CC today or ealry next week, we did have the case expedited at USCIS, hubbys had his medical, so how long roughly from this point can we expect the interview? we will be asking for a rescheduled interview as soon as possible, the hubbys secured a job in the usa, an there are a few more legit reasons such as him supporting 2 households ( UK & USA) etc, so excited, just want a rough estimate of weeks until interview, thanks guys and good luck!

An average estimate is normally 4-6 weeks from CC. so if you have CC next week, he should hopefully get an interview scheduled for very end october or early novemeber, and then when its assigned you can email them requesting an earlier date.

Mention the kids and the illness etc, but dont mention his lined up job because he 'could' into trouble i believe if he has accepted work before legally being able to, I think its only an issue if he starts work before then, but just in case I wouldnt mention the job thing. A guy on another forum mentioned it and apparently the CO grumbled at him for it.

  3. Ok so just going over everything a million times as we are near CC any day now, On my hubbys police record he has 1 charge, vandalism, when he was 16, he broke a few windows got fined 150gbp, he has the court records and stuff, will this affect us? im pretty sure it wouldnt but never know with this visa, also, he over stayed his visa waiver by 147days, but left on his own, i was very ill at the time an he stayed to help with kids and with a lawyers word he wouldnt have to go home we could adjust with him in the states, this turned out to be a bunch of b.s we now know, will this affect his visa?

Just in case get a police subject access, he requests it from the police station where he was charged I think, then if the embassy officer asks for information he can hand him the access page , this is what many people do :)

Yeah the whole AOS from VWP is illegal and a icky area... it can and has been done.... but often needs major lawyer assistance and can take way longer than doing it this way, plus there is a chance they could of said no and deported him, so he was right to leave and do things the right way :)

You will be fine though I think, just be prepared for both to come up at interview, and have him answer things honestly and with a smile :)

  4. our anniversary is oct 14th be sweet to get home before then, ill be asking the embassy to bring the interview date forward of they can so i hope it shouldnt be to long i just want a rough figure weeks wise what we are looking at from where we are now

well based on recent averages. I would say.... 2 weeks until CC, 5 weeks until interview.... so if all goes well expect an interview around 10th October maybe? who knows. Also depends on how busy they are.

Someone i know had CC end of july, and was assigned at interview date 1st week of august, and date was sept 23rd, It all varies :)

  5. Ok we we had our case expedited at USCIS for my sick health an loss of earnings and being in difficulty with our child and needing my husband back for many reason etc etc and were approved, we have paid both AOS and IV bills we are mailing the ds230 an I864 an everything else monday. how long can we expect now providing no hickups or RFEs until his interview in London and whats the chances if any we can ask for an earlier interview once assigned one?

it normally takes them about 2 weeks to look over and approve the packages if you have no RFE's. then you will get Case complete. If you get it in the 1st or 2nd week you get an interview date quickly normally but if you get CC in the 3rd or 4th week you may have to wait until the 2nd week of the next month to get one scheduled, as NVC says they only schedule during 2nd week... not always true but about 80% time it is.

Its normally between 4-8 weeks from the date u get CC to interview day, mine was 6 weeks, some recent people had 4 weeks. Yes if your hubby calls the premium rate london embassy line he will get a unique code to enter into a subject line of an email. You then email the embassy asking for an earlier date ans hoping they say yes :) The code chnages daily so u need to call before u email.

  6. ok we have a lawyer that filed our i-130.i dont recall giving pictures other than the passport ones.i also got something notarized.my husband might have gave lawyer a few pics but never said anything...i thought we needed our proof during the interview process...now im a little concerned...but i thought the lawyer knew best...:(

If you read the instructions for the I-130 it lists what you should submit with it, what is optional, what is needed/recommended etc. Nothing you can do now, but hope you sent enough :)

  7. Ok so my British hubby got his police check done as our case is at NVC, it shows a minor charge for vanalism at age 16, fine 160pounds,he was told it was wiped from his record at 18, now he for sure cant get the court record as again, it as destroyed at 18, is this going to be a problem, i no on the ds 230 he will now have to put the charge, will this affect us in anyway?

Tell him to inquire, because I doubt his record was 100% destroyed. If it came back with a charge then it means it is still on paperwork somewhere, so he may need to inquire about a written statement about what the charge was for etc.

I believe it is called subject access or something? http://www.acpo.police.uk/NationalPolicing/ACROCriminalRecordsOffice/SubjectAccess.aspx He should look into it, and request one, I think they are pretty easy to get.

They may want to see it at interview, just to make sure it wasnt a bad crime etc :)

  8. DCF out of London is the best option you have got. With all the documents set in place and speedy response to anything the Embassy tells you or asks of you may get you with your visa in hand in 2-3 months. Look for people who have done DCF through London, their time-lines are really short. Good luck with your next visa journey!

not at the moment. I know plenty of people going through DCF at the moment and its been taking 5-7 months right now.

  9. NO we will be livin alone just me hubby n kids, my dad lives alone no dependants an already has made over 28k for the year, he has been working since febaury at current job so i hope, pray this is enough :( he only filed one tax return, 2010, in last 10years due to sickness

make sure he has a letter stating the reason why he wasnt required to file then. I know only the most recent years is asked for, but if they do ask for the past 3, you'll need to show a letter showing exactly why he didnt have to file i.e sickness.

In addition to supplying your dads current jobs pay stubs, make sure to also get a note from his employer, stating his position and estimated yearly salary.

  10. Ok so heres the facts surrounding me our case and the co sponsors situation

    1. Our case was expedited due to my emergency op and loss of job creating financial hardship as i have 2 small children

    2. The co sponsor is my dad, 48, in 2009 my hubby donated a kidney to him saving his life. in 2009 my dad worked for walmart right through until February 2011, he only filed tax for 2010 year as previous years he was on SSI and wasnt working. he now currently as we moved back to Texas has been with the same job since February an makes well over the 125% poverty line, his last SSI payment was the first of this month but we dont no if thats included in earnings so we are going by his wages alone as to how much he makes at his new job to be the sponsor

    3. we lived together in 2010 ( me and my dad) i didnt work so he claimed my children as was head of household, i have my tax returns for 2008 & 2009 however they dont meet, the earnings for that year should i say, above the poverty line.

    4. Regarding my husbands job prospects etc he is a college grad an has worked as a bar manager since returning to the UK in April.

Now my fear is they will decline my dad as the co sponsor for several reasons such as not been working long enough (nearly 2 years). Length of time at new job.

Can anyone give me any peace of mind for my situation :S

Often I hear a general rule of thumb that CO's look for is 6 months at least in current job, however even if you have more they can sometimes request another sponsor. I would say you'll be fine if he has documented income for the last 6 months, and filed his tax return etc correctly, as long as his income can support the total no of dependents etc he has. Did you say you and your hubby and family will be living with him after you get your VISA?

  11. I am totally confused about it! All I know is they are saying that my case can not have a service request fulfilled until after it leaves Phoenix. I never imagined I would be at another Lockbox this is crazy! thank you for your replies and time!

heh your welcome, Im just sorry I can be more helpful, But it is very weird, never heard of it getting to the service center then re-routed, all I can think is perhaps they are busy which I know CSC IS the busiest center.

'Hope you hear something soon, keep us updated :)

  12. It may be important to mention that in 2007 I brought over my ex wife from Cuba on a K-3. We divorced May 2010. Do you think she may have tried to adjust status and that is why they are doing this to my case?

I hope but have a hunch it may be that ex!

Hmmm well surely they wouldn't know that until it had actually ARRIVED at the CSC, As that is when they start reviewing everything. If you haven't had NOA1 yet, that means its still probably in its envelope and on route the service center.

Oh wait just read ur timeline, you HAVE had NOA1, so it must have got to CSC, and is now in phoenix.... hmmm maybe its being sent to another service center then. not sure :(

  13. Yes, it has left from Chicago to Phoenix but why would two lockboxes have it and why all the touches?

Only thing I can guess is perhaps a bit of a backlog. Maybe chicago was so busy, that before sending it onto CSC, they sent some to phoenix? Not sure really. If you called and found out its there, could you cheekily ask them why maybe? :)

But I wouldnt worry too much, Im sure CSC will get it soon :)

  14. Still nobody knows? Did this happen to any of you all?

Honestly once id mailed it, I didnt really check it too much lol. I started logging in to the USCIS website about 2 months after it was sent, to see if it had any 'touches', didnt see the point in checking sooner because I knew it wouldnt have had any lol.

Just give it a few weeks and then it should be with CSC and you can send your expedite letter off.

  15. Thanks! I think I'll aim for about 7.20ish. I dont know why but I'm really nervous about it!

    you'll be fine :D

They started letting us go through security at just after 7:30am, I was inside sat down by 7:45 :)

And was out and done by 9:30! So nice and swift I thought

Yeah lol I got there just after 6am, so sat and read my paper, i cant help it, im ALWAYS early wherever i go hehe

  16. Hi! I requested an expedite so I called to check the status. When I did they state that my case is still in Phoenix and that they can not process my service request until my case is in their possession. But, I mailed it to Chicago so what is up?

you only sent it on the 18th :) Give them a bit more time to get it sent to chicago :)

  17. Here are my questions (sorry if they're obvious, I'm probably being dumb here):

    1) I don't really understand the guidelines, who is included in household size?

    2) Can the sponsor be currently unemployed? What if he meets the poverty guideline in previous jobs?

    3) What if the sponsor is moving, but doesn't have the new address yet?

    4) How long does it take to request the tax documents?

Ugh, for me this is the worst bit so far.

    Thanks for your help!

yes the sponsor can be unemployed, you will just need another sponsor also. Nope, the income must be CURRENT and provable (i.e wage slips) . If the sponsor moves simply updates the NVC with the new address, or wait to send the paperwork until they have moved and u have the confirmed address.

Tax transcripts can take anything from 5 days to a few weeks, but they usually arrive within 10 days time :) Or you can send in a copy of the full tax return plus any 1040's or W'2's. You can send in either only the most recent years or the previous 3, we only sent in one and it was accepted no problems :)
