To the original poster, filing anytime during the 90 days preceding expiration of the green card is fine. The only "issue" is that you will get your new green card later.
The process takes much longer than 90 days for most. Your receipt notice extends your green card for one year. Its not necessary to actually receive your new green card before the old one expires. (And no need to ask for an extension(?)).

What do you mean you've "been away for several years"? A permanent resident is just that, a RESIDENT. If you are saying you have been out of the country for several years as an LPR, you might have some problems. LPR's aren't supposed to leave the US for more than 12 months consecutively. And even if you came back for a week or two to break up the "several years", they don't like this either.
I'm not saying you will be denied because of it, and situations do happen where people have to leave for extended periods, I just want you to be aware that it might cause you some hiccoughs.
edit: Looking at your timeline it looks like you might mean "away from VJ for several years", in which case, nevermind!

Hello VJ,
We've been away for several years. And I guess you could say we waited until the last moment to petition to remove conditions. My wife's GC will expire in the middle of March 2012. Can anyone see any issues this may cause? Thank you.

Don't worry about the expired I-94. We applied for AOS almost two years after mine had expired and I we didn't have any problems. Our case was approved in two months.

Yesterday we received Sasha's permanent resident card and welcome letter. Finally finished! Thanks to everyone for all helpful info. Peace!

:dance:Sasha received her Green Card yesterday in the mail. Without an update (touch) to portfolio on USCIS.gov. So it was a very nice surprise. In total it took only 60 days to receive approvals for all three applications (EAD, AP, AOS). Finally we're finished! Sasha wont really benefit from a naturalized U.S. citizenship, so we may opt to keep her as a permanent resident. Will make traveling back and forth to Russia much easier and cost effective. Done with USCIS. For a long while anyway. Good luck to everyone still waiting....

My EAD and AP were touched on March, 9th, EAD was approved the same day and AP has been in the initial review stage ever since. However, I got my AP docs in the mail today. I guess, payxibka is right, online system is not completely reliable. I hope you'll get your AP very very soon. Good luck!

I'm going to apply for fee waiver request for I-485.
The poverty guideline is $10830 a year, which is $905.5 a month.
So my question is, if i have income more than that, does it mean that i'm automatically not eligible for a fee waiver?

No, you are still eligible as long as you can show USCIS that the money you earn is enough only to cover your living expenses like food and bills and that you don't have an opportunity to save money for stuff like AOS. Send them copies of your bills.

We sent two checks. One (80$) for biometrics and the other (930$) for AOS.

I think the rejection notice was directed at the fee. It wasn't your application which was rejected. It was the payment. I'd simply resend the I-131 without the payment and maybe include a letter of explanation.

It appears that Sasha has been "out of status" for quite some time (more than 180 days) since her I-94 expired... Correct? If so, then AP will not help.
Secondly, biometrics is performed at the Application Support Center and InfoPass is at the USCIS field office... not the same place and may not be anywhere near each other
It appears you are wrong. Legally married K-1 entrants are NOT out of status if they wait to file AOS. Don't know where you got that idea. 90 days was simply the window to marry after arriving. And the I-94 expires the moment that applicant enters the U.S. So, is everyone out of status before and after they get married until they file AOS? Of course not. We heard from the officer at the local office of many many couples waiting years to file and didnt have problems traveling.

Your press release is NOT intended for married K-1 visa entrants applying for AOS. There is NO set window of time to adjust once married legally within the 90 days given by the I-94. An applicant who waits more than 90 days to file after arrival is NOT here illegally. Illegal aliens are subject to these bans. I-94s are expired and void once the immigrant enters the POE. Hence, the reason its only good for ONE entry. Otherwise an immigrant could come and go everyday until marriage or the 90 days is up. Read the release again!

Well, with a few appointments to our local office we've learned that she is NOT out of status and will be able to travel once AP is granted. No bans. That is for all other visa types that overstay. I appreciate everyone's input but I guess I should have gone to our local office first. I trust the few officers I spoke to who have worked there for many years.

I was told that joke in Amsterdam one year and at the time I thought it was insulting to me. But after thinking about it for a while, it was actually pretty true. And I learned to laugh at it. Well when you speak the world's most common language, schools just have no need to make other languages mandatory. Hopefully our son will be multilingual.

I think he just needs time out meeting your friends. He needs to build a social network and this will also help to better his communication comfort and understanding. It will definitely take time, but I wouldn't encourage him to stay home. He can get hands on studying if he dives into making new friends. My wife stayed home for the first year of our marriage and nearly half of the second. She was pregnant and he was born in that period. I regret not encouraging her to be more involved socially. Hope you won't make the same mistake.
