  1. I filed my AOS co-jointly with my I-765 on May 23rd. It took me a month to get e-mail notifications for all three applications (I-485, I-130, I-765). A few days later I got two notifications in the mail for the I-130 and I-485, no I-765 notification. A MONTH later (almost 2 months total after filing), I get my hole I-765 back saying I didn't include a check hmmm ok. Obviously not needed since I filed jointly in the same packet.

I shrug it off and just send a whole new packet a few days later and I include my receipt for the I-485. Now another 4 weeks later (close to three months since original filing) and I receive the WHOLE packet back again saying I did not include fees and/or I did not include the I-485 receipt notice. The funny thing is that in the packet they sent me back the I-485 is right there and it even had USCIS markings on the side.

Now I'm not sure how these people function or how they process these things, but it seems to me that the people doing this function like robots and reject anything that is even slightly messed up.

What makes it worse is that I've had this job offer since May 10 and I told my employer it would take around 60 days to process it, now I don't know what I'm going to tell them when they email me to check on the process. I'm really trying to hold on to them because it took me almost a year after college to get that job. And right now I'm waiting for my green car interview letter and I don't feel like applying for the EAD again. But that could have a serious backlash if my green application drags on much longer than expected.

    Ok I'm done ranting.

  2. Looks like things are starting to pick up, we should have more interviews this coming month!

Got my RFE hard copy requesting tax transcript. I anticipated this and ordered the transcripts a few days ago, hopefully I get it early next week and the RFE will be on its way. It also states my I-765 will be processed when I send the RFE back, but it just seems to me like that's what it says on all RFEs (generic message)? Or will they really process it when they get it.

It's been more than two moths since I got my job offer, the company is starting to get really impatient with emails all the time and I really hope they process my I-765 as stated on the RFE when they get it.

  3. Prep.mac that is pretty ridiculous. For one, they should have it on file; for two if the Initial review saw a red flag they would have requested it before the interview and for three it's not like overstaying is that big of a deal when it comes to family petitions; the main reason why overstay matters is that if you are denied (for other reasons) then you become deportable.

My guess is that he was just trying to scare you and you will get the approval email/text here in the couple days, I certainly hope so. Good luck!

As for me, I received RFE (text/email) yesterday. I expected this, but I wish it wouldn't have taken this long to get it. Oh well.

  4. Mine showed recd on 7/7/11. No email, no check cashed, No NOA-1 in the mail yet or my package back....

    Wait 30 days. Relax.

And if you were to get your package back, it would take longer than that.

    See my signature.

Sorry to ask this but what does NOA1 for EAD & I-485 hardcopy mean? I should be getting mine in the mail tomorrow or next since I sent in my application on the 9th and they confirmed delivery already.

    They're just receipts.

  5. Thanks!

I see you had about a month wait too. Also, I see in your sig (and other's) that you specify a "NOA Date" in addition to the NOA "Hardcopy date" --- is what is the difference? Is the NOA date just what is printed on the actual NOA? Or do you log in somewhere to actually see if the NOA was issued (before getting anything in the mail)?

The first one is when I got the text/email; the second one is when I received it in the mail.

  6. After you do what has been suggested up there, do NOT panic if you are unable to see a surgeon before the expiration date. It will only matter if you are denied (her overstay will come into play); and even then, unless those surgeons are like months behind in appointments booked I don't think she'd have accumulated enough overstay time to warrant a ban (IF denied).

So again, try everything you can; but if you can't it shouldn't be that big of an issue.

    Good Luck!

  7. My I-765 got returned to me today because of no fees (filed concurrently, which doesn't make sense) and "outdated form" which also doesn't make sense because it say Jan 11. And I also received an email from a company that offered me a job in May asking if I'm going to get the papers soon.

Now I need to file again and God knows how long that's going to take. :bonk:

  8. I applied for AOS, and I just received a NOA saying my I-765 has been rejected because:

"1- The check amount is incorrect, or has not been provided. Please review the Form Instructions for fee information. Please resubmit your application/petition package with the appropriate fees to the USCIS address listed on the bottom of this notice.

2- The application/petition was filed on an outdated version of this form. Please resubmit....."

1- I filed it along with my I-130 and my I-485, so I know I don't need to pay.

2- I used the correct form, it says on my application that was returned to me (Rev 01/19/11).

But anyway, I have to resubmit it now; anyone has had such an experience? What do I need to attach with the form?

    TIA.
