  1. ok, so, we did a request for expedite over the phone, faxed the documents and a few days later we recieved the denial email.

    my wife contacted the senators office, because we felt our expedite request was valid, the senators office contacted the uscic, and we found out that they " never recieved the supporting documentation," the senators office asked us to fax them what we sent to the usics, and they would send it again and ask them for it to be reviewed again,

    we just recieved this email from the senators office:

    Please see the response below from the USCIS regarding the expedite request for your husband’s visa. Thank you!

    Good afternoon Laura,

    Your request to expedite the adjudication of this I130 petition was approved and the case has been assigned to an officer for adjudication. Your constituent should receive a notice of action* within 7-10 days.

    got a question... about the I-864...again....

    My wifes brother will be the co sponsor, he got his W2 today but the income was $22k + some.. he has a biological son, even tho he dosent have cutsody and is not allowed to claim his son as a dependant on his taxes I am led to beleive he is still classed as a dependant for the purpouses of the i-864 , meaning the fmaily size is 3.

    the current 125% poverty limit for a houshold of 3 is $23,162 ( for now )

    he has only been employed 6 or 7 months, and is expected to earn over the requirement ( W2 is 22k for 6 months of work) .

    would a copy of his W2 , copies of pay check stubs ( hes saving them all for me ) and a letter from his employer stating an estimated yearly income be enough to satisfy the NVC and the london consulate?

    I hope it is, my other options are limited

  3. Obviously I'm a lifetime away from this stage, but I was wondering,

    Dose the USC file ds-230 with all the requested evidence, my birth certificate, passport photos of me , marriage certificate , police certificate ect after I appoint her as an agent ? Or do I , the ukc file it from the uk?

    When is it best to gather the stuff? I already have most of it , aside from the police cert

    Should I mail her what I have now.. And when I get the police cert mail that to her, or wait?

    yes, my wife sent of the paperwork january 3rd

    his income is ment to be 34-35k a year,, which is comfertably over the req, but hes only had a job for 8 months, 2 months of which was training pay, and his tax return will reflect this, im sure he can get a letter from his employer stating the estimated income for the current financial year, that hes full time employed ect , plus check stubs and such, Im hoping this will be sufficient, as we have no other options beside her and the kids moving over here to the UK, which would entail taking the kids away from their school friends and family

    I have another question. as we are are using a co sponsor because my wifes income is 0. the thing about using assets to prove 3X the difference between household income and poverty limit dose that work for the co sponsor.. or would he use my wifes and my assets to prove 5X the difference?

    for instance, the poverty guideline for 3 people is $23,162 , lets say he earns $22,162 would assets of $3000 or $5000 be required? can our assets be used in conjunction with a co sponsor in this way?

    Im sorry for the silly questions, my wife is pregnant, and im hoping to have the visa by the time the baby is due, ( approx 7.5 months ) so im trying to make sure that there is no chance for denial or a RFE, this is the only co sponsor we can get, hes been employed for 8 months as of this date ( he gave me a check stub dated mid december that was $239 short of the requiered $23,162 we can get more check stubs, employment letters closer to when we need them and his tax return should have the required income on it by the time its filed, im just trying to organize my thoughts.

    my visa application is still in the early stages... by early.. i mean pre noa1.. but i have a question

    my wife is unable to sponsor me on the I-864 due to the fact she has not worked for the last 6 years, due to having bipolar disorder and applications for social security benefits being processed, her and my step children are claimed as dependents on her parents tax returns. so we are using her brother as a co sponsor ( her parents wouldn't make enough for the required household size)

    my question is, her brother makes enough to sponsor me ( he makes over the required for 3 people...barely ) , but on I-864 question 21D it asks for the number of dependent children, he is divorced, and his ex wife is the primary custodial parent over their son , in his divorce decree it states that she is the only one allowed to claim their son on her tax returns, meaning he is not allowed to. there fore his tax returns dosent state his son as a dependent.

    how would this work? dose he still put his son down? because it says about even if the dependent child dose not live with him to still put him down,

    or because he dosen't claim his son on his tax returns per the divorce decree dose he not have too?

    he dose however pay child support ( or has recently started too )but we arent sure on the legality's of what constitutes as a "dependent" in this case.

    any help would be appreciated

Hey all , where currently filling out our I-130 for a CR-1 Visa, and have a quick question, Im currently here on VWP, and i used the ESTA thing online,( so i dont have an I-94) I am currently in the us obviously but intent to return to the UK in January , for question 14 should i put ESTA and send a copy of my ESTA authorization even tho I am going home? and should I include a copy of my passport page showing my entry stamp? it gives the date my VWP entry expires

    before my fiancee and i begin the I-129F process, there is a few question i would like to ask

    my fiance has bipolar disorder that prevents her from being able to work, she lives with her parents and her 2 kids. now. when the time comes for AOS we have a co sponsor that makes the required ammount for the 125% poverty line but will not be available to sponor untill im actually over there

    my question is as follows

    I have read that London allow self sponsorship , ive heard various things. such as requiring the poverty limit for 1 person. only needing a couple thousand pounds. needing money for 90 days.

    i was wondering if anyone has self sponsored at the london embassy recently can give me a better idea. i have about £9000 ish at the moment. and by the time the interview comes around it should be a little more. is this enough to satisfy the consul officer in london do you think?

    If so, what will i require to bring? bank statements? letter from the bank saying how the money will be transfered to a us account?

    any help would be greately appreciated

    my fiancee and i are planning on getting married , and as such we need to begin the k1 Visa process, but i have come across a hitch

    she has 2 children from a previous relationship and due to health issues she is unable to work, she and the children live with her parents, and her parents claim her and her children on their tax return.

    how do we go about the sponsorship issue, would she have to submit the i-134 and her parents as co sponsors? how do you suggest going about this?
