Does he needs a swab test or papers that he do not have covid? What are the questions of the immigration? Is there anyone travelled from the Philippines to using tourist visa to USA with no problem?

I never reported my marriage and what will happen to all my kids? Are they gonna be automatically dual citizen too? I need the step by step process pls help! Thank you!

  3. OK, I fill out the DS-160 already but I have no idea how to pay the Visa. I know you have to go to the BPI bank, what kind of form to fill out again before going to BPI bank? The lady told me that its not the DS-160 form, and never explain what kind of form. IS there anyone who can help me what kind of form to fill out to pay the visa? Please help!

  4. Why? Because the OP asked in his other thread about adjusting dad in the US after he enters on a tourist visa.

You are correct! No worries, I did repetition my father for I-130 just filed last week.

    Thank you....

  5. While in general round trip tickets are cheaper, there have been posting in VJ from folks traveling from the Philippines that say it is cheaper to buy one way tickets.

As other's have said OP, better to buy a round trip ticket or two one way ticket to show that he will be returning back home.

Yes it is cheaper to buy one way ticket from Philippines to US.

Just an update I purchased round trip ticket guys.

    Thank you for you suggestions...

  6. Hi,

It's immigration fraud to enter the US on a tourist visa with the intent to immigrate by adjusting status. It's a VisaJourney TOS violation to assist you with this plan.

You may want to read Matter of Batista and Matter of Cavazos to understand the law.

    Best of luck.

Can I petition him while he still in our country?

  7. As you can see, they are not impossible to get, just very difficult. Glad this one worked for you.

The real key is overcoming the presumption of intention to immigrate. Usually if you have a valid reason to visit there, such as seeing family, and have things you don't want to abandon in the Philippines, like a good job, real estate, or something else of value, you will get it. But you have to think it through because I just oversimplified it a lot.

I think my father's case is different. I petitioned my father 4 years ago but after staying here in the US for 3 months he decided to go back to the Philippines and he abandoned his residency here in US. He surrender the 10 year green card then the C.O ask my father only three questions and never ask any papers or documents.

    1. What are you doing in the US?

    2. How many kids do you have in the US?

    3. Why you don't want to live in the US?

After that three questions C.O told my dad to wait 1 week for your visa.

  8. You can complete the DS-160, but by law your dad must click the submit button, so once completed save it with a password and send the info to your dad.

Thank you so much for the help. I just talk to my father, his tourist visa is APPROVED! I appreciate all the people who helped me here. I have another question, does my dad need to attend CFO seminar or PDOS?

  9. Hi,

    These are my answers.

    1. Yes, your sister can use your address and then change it after they bought a house. They just have to tell USCIS their new address and go to this link - https://egov.uscis.gov/coa/displayCOAForm.do

    2. I answered your question about Civil Surgeon on your other forum "Civil Surgeon" - http://www.visajourney.com/forums/topic/547403-civil-surgeon/. Hope you read it I listed all the step by step process I did. The Medical examination is good for one year like for example your sister had her medical examination < 12 months until this time, there's no need to have a physical examination for civil surgeon. The vaccination report is important for the civil surgeon to fill the I-693 form. But again, going to a civil surgeon is optional especially if you have all the vaccination needed. :)

    3. No, her husband does not need to fill up the form I-485 if he is a US citizen. I was the only one who fill up the I-485 form part but my husband did submitted the form I-864 (Affidavit of support part) . As for the G-325A, I also submitted my husband's G-325 A but I think it's just optional. You can wait on other VJs reponse on this. - http://www.uscis.gov/i-485

    Hope this helps. :)

    Thank you Sweet01

  10. I have a lot of questions please bare with me. My sister entered as K1 visa and it's been 2 years now and she have not file for her AOS due to her husband's busy work schedule as Military. Now that her husband is not in the military no more they are ready to file AOS, but the problem is my sister is having a vacation and live with me for awhile while her husband is busy working in the slope and finding there house to buy. My questions are;

    1. Is it ok to apply her AOS and use my address after they buy a house then change it?

    2. Does she need to do the Physical exam for civil surgeon or can I go to the public health and do all the vaccination and bring it to civil surgeon?

    3. Does her husband need to fill out the g-325 A and form I-485?

Thank you... Hope to hear answers..
