  1. Does the date that you tell the officer at the interview that you are planning to enter the US have to be the date that you stick to? me and my fiance have our K1 visa approved he told the interviwer that he was planning on entering the US around march but now we are thinking of him coming in june will this be a problem at the POE we had sent in documents when we first started the process about wedding plans and reciepts for a venue and for the wedding to be in april but now this will prob change to june will this all be an issue at the POE? thanks for any advice

  2. Does anyone know the correct floor level to send packet 3 to for the sydney consulate when they first sent me packet 3 via email it was this address, with all my other correspondence with them they are listing level 10 instead of

59 to send it to on the address, does anyone know which is the right one or if they changed procedures or something thanks for any help.

    U.S. Consulate General

Attention: IV Unit – PKT 3 DOX

    Level 59, MLC Centre

    19-29 Martin Place

    Sydney, NSW 2000

  3. Does anyone know what happens if you put yes on the DS-156 question 38 there is a question that says have you ever violated the terms of u.s. visa or been unlawfully present in or deported from the united states do they require you to submit proof of it or how long you had stayed? or do they question you alot at the interview? my fiance had only overstayed his visa wavier program by 2 days and somehow has lost his departing ticket from the US so i'm kinda nervous about the whole thing .The stamps in his passport only show his arrival and how long he could be in US but not his departing date from the US. Thanks for any help

  4. Hi I have a question about I-134, my mom is my joint sponsor she never really liked her first name so she always went by her middle name on all her documents bills etc but never had it offically changed so when filling out the I-134 we put her real name (the one she does not like) on the forms as it is the name on her birth certificate which we are including in packet 3 , but when it comes to her tax returns and pay stubs etc it all has her middle name on them as her first name do you think this will cause any problem or confusion with the embassy thanks for any advice just kinda nervous about this lol

  5. Has anyone ever heard of doing a statutory declaration if you cannot find your shot records already have the titers blood test done but for some reason they cannot test for one of the things listed tried tracking down old doctors but they do not have the shot records as they only keep them for 7 yrs and its been way beyond that was thinking might just have to get the shot redone as a last resort but thought ask here thanks for any help.

  6. You can't have filed income taxes yet for 2011 because the year isn't over. The taxes you filed this year were for 2010. Therefore, the last 3 years tax returns would be 2010, 2009, and 2008. You will file your 2011 income taxes next year. Any info. you put from your tax returns would be from 2010 (most recent) and prior. It would help us if you could tell us what questions you are asking about specifically, we could maybe give you a better idea of how to answer them.

yea the taxes were 2010 taxes since I do not meet poverty guideline since I am not employed should I still include my tax and bank documents since they are going to be looking more at my moms financial documents since she is the joint sponsor and the one who will be meeting the poverty guidelines thanks

  7. I am unemployed at moment due to school so my mom is going to be a joint sponsor I filed income taxes for this year because right before I went to school I had a job but quit so I am pretty much relying on my moms income alone I do have some savings in the bank about 3,000 do I need to put my savings and 3 years tax returns for my I-134, also my moms income is enough to make it but I was wondering if I have to put my info like the tax returns and savings or just leave blank considering i'm unemployed now and my mom is filling out her own I-134 and listing all of her things. Thanks for any advice

  10. When requesting an extension do you really need packet 3 completed this is the reason I need a 4 month extension to finish it up I sent a e-mail to sydney consulate requesting an extension this is their reply:

Your I-129F petition will have expired by the time you attend your final visa interview. To revalidate your petition, please have your U.S. citizen fiancé provide you a letter, requesting that your petition be extended to a further 4 months from the approval date of the I-129F petition. This letter must be dated and signed by your fiancé.

The letter from your U.S. citizen fiancé(e) should state their intention to still marry you within 90 days of your arrival into the U.S. with the K-1 visa and that you both are still free to marry.

You should send this letter with the required Packet 3 documents.

When you have obtained all of the documents required for your case, complete and mail all of your documents (do not fax or scan) with DSL-1076 to advise the U.S. Consulate General in Sydney that you are ready for your final visa.

Within 30 days of receiving the packet 3 required documents, a confirmation email will be sent to you (known as "Packet 4") regarding the scheduled time and date of the final visa interview. Please be aware, final visa interviews are scheduled for Tuesday mornings only. You will be scheduled for the first available date.

anyone have any experience just sending in the letter requesting the extension by itself??thanks

  11. I'm a student and don't have a job yet to sponsor my fiance on my own so my mom is going to be a joint sponsor for me we are just under the poverty line we are going to use the house we live in as assets to make up for the difference we need does the house have to be totally paid off and the house is under her name her husbands name and my grandmas name is this going to be ok? she also has a life insurance policy which I don't think is for alot and a car that is totally paid off, she has her tax returns for last 3 years they were filed jointly with her husband together they make over the poverty line good but her just alone is hard to get past the poverty line, she also has a letter from her employer with recent paystubs and also recently had the house appraised any advice if we could do this with the house or just with the other assets alone or all assets listed combined thanks for advice.

  12. I'm going to have my mom and grandma co sponsor for me I'm a student at the moment so I don't have a job just yet, with both of them together we will meet over the poverty line by just a little bit like $1000-2000 my mom has a job and my grandma is retired. For my mom would her providing her tax returns for last 3 years and the letter of employment with recent pay stubs be enough evidence, as for my grandma because she is retired what kind of evidence will she need? she just gets social security checks and she has her tax returns for the last 3 years also. Do they also need to include their birth certificates and photo ID copies? thanks for any advice

  13. Hi i'm trying to figure out how to extend my noa2 I've heard you have to email or fax the embassy a letter but I have no idea what e-mail or fax number to send it to or how to get these fax numbers or what e-mail to send it to do I just send it to the e-mail they sent packet 3 to me in anyone have any advice please this is for the sydney consulate thanks, just trying to figure out how to get started.

  14. With the police reports I know it was saying for where you lived in more than 6 months do they mean like country or city, state? my fiance has moved only 2 times since 16, lived in both places for more than 6 months same state and country, I was looking up the police stations and which areas they serve the 2 cities are on seperate police stations so does my fiance have to get 2 police reports or just one he's from australia if anyone has any advice would be helpful thanks.

  15. Me and my fiance recently recieved packet 3 and are getting paperwork together so i've been doing research on the financial documents and I came across this

"Not having adequate income will not usually be a problem if you have a co-sponsor, according to experiences

posted on the newsgroup, as long as the co-sponsor has adequate income/assets.

Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will

be immigrating, and his/her own household. However, that IF the US fiance has been on welfare or other

government benefits for a lifetime or has no plans to work actively, the consulate can still deny the visa based on

the likelihood that the foreign fiance will become a public charge. Just having a co-sponsor may not be sufficient.

An actual case has been documented wherein a fiance visa was denied because the petitioning fiance was on

government benefits and would not be working, even though the US fiance had two co-sponsors."

my fiance has been on welfare in australia for 4 yrs recently got switched to disability due to a anxiety problem, he has worked in the past for 5yrs his work history and info is showing on his biographic data sheet and he plans to get a job when he arrives in the states will this be a problem for us? I am also a full time student about to get out of school so I am currently unemployed but I have my mom and stepdad to co sponsor they make over the income requirement so I hope eveything goes ok will any of this be a problem any advice is greatly appreciated.
