  1. Send tax transcripts that you get from the IRS (either request them to be mailed or download and print them). You won't need W2's with transcripts. Also, transcripts are from the IRS which PROVES you filed. They want the proof. Anyone can send in a filled out tax form, doesn't mean it was filed.

    I sent IRS transcripts direct from IRS did not send any W2s thinking Transcripts would be better, But the Wife has NO W2s to file she has not worked in the USA and we have no plans for her to start.

    So not really sure what they want> plan to write them a letter this week include my W2s along with affidavits from several friends saying they know us to be happily married. also itinerary of our up coming trip home. but now the wife is worried about getting back into country. Because 2 year card is expired. but we do have letter when if we file say ok to travel

  2. Are you sure you sent the IRS transcripts? I ask because you mentioned the RFE says,

    1) All of the evidence submitted was dated recently and does not cover the entire marriage period with exception of tax returns that are incomplete, Statements such as W-2 were not attached.

    It's my understanding that they ask for W2s only when tax returns are sent. But if you send tax transcripts, that's better and there'd be no need for W2s.

    Also, the evidence you send has to cover the duration of your marriage not just recent evidence. I'd suggest looking for any mail addressed to both of you.

    Life Insurance, Auto insurance

    Benefiary on retirement accounts

    Cellphone family plans etc.

    I diffidently sent transcripts. that's what I don't understand thought I was giving more then they asked. also airline tickets home,

    but believe they want the Wife's W-2 and we have none. guess I will need to send affidavits from friends and letter explaining the wife didn't work along with my W-2s Pictures

    You have not established that the marriage upon which you were granted conditional status was entered into in good Faith. You provided some evidence of marital bona fides. however, the documentation submitted is insufficient because of the following reasons.

    I submitted transcripts for all years with both our names on them, but the wife has not worked so has not W-2s

    do they want my W-2s or what do i send my entire tax returns ????

    we plan to fly home in June for a visit Now worried about leaving country

    We have been inseparable since meeting but don't have much with both our names tried to get car loan with both name but bank wont put her name on loan.

    have thousands of pictures

    what do we send Now pictures and affidavits from friends ??

  4. This is what we're in the process of doing (also using the Dublin embassy):

    ~Police certificate from both Ireland and South Africa (his home country. That one is supposed to take months)

    ~vaccination records for him from SA and for his son from his son's doctor in Ireland

    ~My information for the AOS he'll need for the interview (happily, I will be hand delivering this to him in April!)

    ~starting to go through emails, texts, receipts, letters, pictures, etc for the "this is our bona fide relationship" requirement smile.png

    ~he's filling out the documents ahead of time that require all his previous addresses, etc.

    He's leaving the medical until he has word from the embassy. While he's here visiting in April, we're getting passport pics taken at the local post office.

    I would love to have an answer to your police certificate for the UK, as I have that same question. We're about a month behind you. I got our NOA1 on the 7th of Feb. Good luck!

    I would get the police certificate from the UK, if you lived there they may ask for it and no reason to get a delay because of not having it

  5. For large sums do NOT use PayPal, Western Union or even your bank. They offer terrible exchange rates and fees. Many of us in the UK forum have used specialist transfer agents. A lot of people have liked xe.com.

    I used a UK-based provider similar to xe.com (Interchange FX) and I was very happy with the service and the rate I received. xe.com offers pretty much the best exchange rates out there. It is well worth the small hassle of setting up an account, providing ID, etc to get much more.

    I've heard the banks just kill you on the exchange rate,

    that's how they make real money plus you pay them to take extra money from you. :bonk: :bonk:

  6. I am not sure about taxes to be honest, but I always sent and received money (that I did not earn), without the need to mention it on my taxes (I do not know if this is ok or no), hopefully someone experienced with this give us an answer.

    As far as sending the money, the BEST way when it come to sufficient amount like your is wiring the money from your bank in ireland to yours in the US.

    If you do not have one in the US yet, you come here, have one, and then log online to your other bank and setup the transaction to your new US bank.

    WesternUnion, Moneygram etc are gonna bankruptcy you, I sent $15,000.00 from my US bank for only $40, WU would cost me $300

    As far as money orders, they are fine but you need to make sure they will be cashed here and will deal with the hassle of making sure its not lost, etc ...

    Go for wire transfer (safer, cheaper, and takes 2 days average)

    have account here will likely just wire. but worried about exchange rate :blush::angry: ,when its a lot of money a few pennies can add up to a few hundred dollars quick :bonk:

  7. Well we now have a second Biometrics appointment in May.

    We had our case suspended because I sent 2 checks for AOS. One I wrote for the wrong amount :bonk: $80 instead of $85 Biometrics fee.

    I immediately sent a check for the correct amount, which was cashed 2 weeks later. We received an appointment letter for April 26. Then a notice saying our case was suspended arrived. I made calls and sent mail asking if we should attend April 26 Biometrics appointment. nobody gave us a straight answer only that we had an appointment.Not wanting to miss an appointment and be told we abandoned our petition. I took the day off work and we went. Now on April 28 we received new appointment for mid May but this one has a different MSC #

    it is one of originally MSC #numbers we received after first filing, but not the same Number as our first Biometric appointment .

    So what do we do now ?? send letter back and cancel second appointment or miss another day of work and go ?? :unsure: :unsure:

  8. I had the same problem as you, pretty much.

    I sent 2 checks one for I-485 and one for EAD. They sent me that EAD check with a rejection notice, together with the NOA1 for both of them. That rejection letter is very confusing. It says that there is no further action to take, then at the last paragraph it says to send again all the package...??? Makes no sense. You know what I did? Called them, and they sounded so confusing! They didnt know what was wrong...I wanted to make sure if I had to send everything all over again, but I ended up not doing anything, and then I got the letter for biometrics....So, I was asupposed to "take no further action".....

    They should redo that rejection letter, it is supposed to clear english...so confusing and frustrating..

    It is very confusing just like most of the process.But my packet also had a green sheet stating to put it on top of my paperwork,when I returned it.

    so have a check written out for $85.00 Biometric fee and copies of everything else in the notice.Plan to overnight everything back today.along with the case #

    because the case number was not written on any of the paperwork they sent me. :bonk:

  9. Had my POE yesterday in Dublin, Ireland. Just to clear things up... Dublin, Ireland IS a POE. You clear US immigration there when flying directly from Ireland to the US. When you then land in America, you just collect your bags... done!

    It took about 15 mins. The Immigration officer was a good laugh, asked me if I really wanted to do this, told me if he saw me in 5 years comin' back with screamin' kids he'd say: I did warn you!

    The officer opened my Visa Packet (the do not open one) took me into a back room to stamp my passport etc. N.B.THEY DO NOT GIVE YOU BACK THE STUFF THAT'S IN THE ENVELOPE.

    As I was walkin' away he yelled back at me: 'Practice saying, "I do!"'

    Done.

    the wife also came threw Dublin and said they treated her well :thumbs: :thumbs:

  10. Given that they mailed you that notice along with instructions to send it back I would wait for the notice and make sure to mail it back with delivery confirmation. If, when you get the notice, something is unclear then I would make a new appointment at that time.

    Well haven't canceled appointment yet. but have written check in the right amount :bonk: copied paper work and will overnight it back to them Monday.

    The people you talk to on the phone are hired customer service reps, no different from the ones you talk to when you call for help with a new computer or appliance. The only difference is that they're not in India. They read from a script on a computer screen. The majority of them know squat about immigration law or USCIS policies. You can try to get an immigration officer on the phone, but even then you might not get the best information. Your situation is not typical.

    Make an InfoPass appointment at the local USCIS office. Insist on speaking with an immigration officer, face-to-face. Explain the situation and see if you can pay the biometrics fee on the spot. Be CERTAIN you get a receipt. Hopefully, that will be enough to keep the momentum going on your case, and trigger them to schedule a biometrics appointment before an IO gets your I-485.

    hate to miss a day of work. But have to do whats necessary

    On April 2, 2012, a fingerprint fee deficiency notice for this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was mailed to you advising you that we have not received the finger print fee, the correct amount, or a signed check or money order. The notice provided you with instructions to follow to submit the necessary payment. Please submit the required payment as soon as possible or we will not be able to resume processing of this case.

    During the acceptance step USCIS reviews newly received applications and petitions to ensure that they are properly filed (i.e. signed by the applicant, appropriate fees, etc.) USCIS issues a receipt number for the application or petition, and sends a receipt notice to the applicant or petitioner.

    Applications and petitions that are not properly filed are rejected with an explanation of why the application is rejected and the corrective action needed. Rejected applications or petitions do not retain their filing date.

    The acceptance step is typically completed within 2 business days of when the application is received. With mail time it may take several weeks for you to get the receipt or rejection notice in the mail. If you do not receive your notice within 30 days of mailing your application, please contact our national customer service center at 1-800-375-5283.

  13. Keep an eye on your AOS case status online. The bad news is that they can accept your I-485 because you paid the filing fee for the form, and then deny the adjustment of status because you didn't pay the biometrics fee. I think the reason they'd give for the denial is that you didn't complete biometrics collection. This would mean your original I-485 filing fee would be lost, and you'd have to start over from scratch.

    I've never heard of a situation like this before. In fact, I've never heard of someone sending separate checks for the I-485 and biometrics fees. I don't think they'd send an RFE since the biometrics fee isn't "evidence". I've never heard of USCIS sending bills or fee notices. I also don't know if the ASC can collect your payment at the time of the biometrics appointment. Again, I've never heard of this happening.

    Sure hope they don't force us to pay the I-485 again. we can't afford it. late filing now waited for income tax return just to have the money to file.

    only thing I can think of doing is call them Monday and send another check for the right amount.

  14. This seems to be the beginning of problems. At some point in time they are going to realize that the fee they collected is I correct. They can do a reversal. Look out for delays. It is super important to read the guidelines when filling out these forms but that is water under the bridge now. I hope someone who has passed through this will enlighten you or they will simply ask you to remit the biometric fees. All the best.

  15. We are totally confused now :help:

    We filed AOS and I sent 2 check with package. One in the amount of $985.00 which was cashed this week. The second check was for $80.00 should have been $85.00 :bonk:

    We then received text 3 messages MSC case numbers in sequence :thumbs:. But today NOA Rejection Notice which states

    Recently you submitted an application for immigration benefits.That form was submitted with an extra remittance that is not required to process your application.your check is being returned to you with this Notice. No additional action by you is required at this time. :whistle:

    it then goes on in the next paragraph to tell us we should complete and resubmit our application :angry:

    what gives ??? the $80.00 check was returned but the $985.00 cleared the bank.

    What do we do wait?? the $85.00 is for Biometrics.I understand this will we just have to pay that later ???

    or do we have a major Issue coming towards us ??
