My advice after bringing wife on a K1, taking 7 years until citizenship and bringing MIL and FIL here which took 9 months is to constantly call the immigration line and or show up to your local immigration office, especially if there is any delay what so ever. My wife's file was transferred to another office and it sat there for 18 months during her process. I was to afraid to "rock the boat" and my experience tells me that was the wrong way to proceed. There are a lot of people who fall through the cracks for whatever reason. Keep on speaking to people until you get someone who actually looks into your case, gives you actual information and helps you. Best of luck.

  2. It seems he is seeking an immigrant visa but is extremely confused about the details. As I said in my first post to this, please read the guides. The civil surgeon in Russia should be able to assist in filling the forms as they don't read/write English.

    Step one is to file the I-130 for each parent. Please read the guides on how to do this as well as the steps that follow. If the immigrant visa is granted they will receive their green cards shortly after arrival, no need to file AOS. :guides:

    Thanks for the clarification. What has me confused is the mention of I-485 form in the I-130 instruction steps for US citizens (statue of liberty on the cover). So, we just submit the I-130 and follow the mailings from the BCINS from there. Would it be advantageous to submit the past three tax returns with the I-130 e.g. just submit the I-864 concurrently with the I-130?

  3. Ah, I see - we can only do the I-130 form now. The moment they are here we can do the I-485. So, same question applies to an extent - I assume they will have to go to a civil surgeon sometime and when does the I-693 form come to play?

  4. that is for AOS (I-130 + I-485) processing, not for VISA (I-130 submittal) processing.

    Which do you wish to do, really?

    Your assumption on the answer should be based on where they are physically, in the world;

    as well as whether or not you are seeking AOS Processing or Visa Processing.

    As is, now, you've crossed the streams, one into the other - confusing folk who wish to give you the answer.

    Please eludicdate - what does your wife wish to chase after? a Visa or AOS, for her parents? TIA !

    AOS technically, heck they already have a two year tourist visa.

  5. You would need to read the guides. Your wife will file the I-130 in the US to start the process. After that there are other steps and forms to file along with additional fees. After the US citizen's part is done the information is sent to the Consulate where the interview will take place and they will be sent a packet with all the forms to file and instructions on what steps are needed for them to apply for the visa. Overall you are looking at about a one year process.

    Instructions allow for I-130 (I-864 etc.) and I-485 to get submitted at the same time. Parents are in their 50's. No opinion on health care from me. I assume the answer is fill out both applications, submit and the top portion of the I-693. The civil surgeon will fill out the rest of the I-693 when they go to Moscow (I assume).

  6. Wife is US citizen after more than 7 years of marriage to born American.................now wants to sponsor her parents from Russia. So, we need for both parents I-130 and I-485 to submit a direct consulate filing for them. They can get all the documents certified translated over in Russia and DHL to us no problem when we fill out both applications for them, but the problem is the I-693. Supposedly we need to submit it with the I-485 packet but the majority of the form is completed by the civil surgeonwith the exception of Part I. So, I assume we only submit part I and the Moscow embassy when they schedule the interview will schedule the examination with the civil surgeon, give them whatever additional vaccines they might need etc. and then complete the process. Am I completely wrong with my assumption. Or, should we fill out the top portion of I-693, send it to them, have them go to the civil surgeon and complete the document and then send on us for when we mail in the concurrent I-130 + I-485?

    P.S. Parents have visited the US on visitor visa numerous times and have never overstayed visas etc.

  7. Very important indeed... I also would make a copy of your drivers license or state-ID, since they will ask for it.

    When there is nothing "special" going on... no need for an attorney at all. Waste of money.

    Yes, both sides of green card - sorry for not originally mentioning that. Will put in copy of drivers license. Should mail out by next Monday.

  8. Wife is green card holder close to 3 years. She has been in the country over 6 years after a fiance visa. Now filing for citizenship. Filled out the application, took 2 passport photos and prepared to mail the application to the place for our State and $675. Now the hard part. What documents should we send copies of to the BCINS without an attorney.

    Documents legally changing name - a. marriage certificate and b. social security card

    So, applying on basis of marriage to a US citizen

    1. husband born in USA American citizen sending the inside of the front cover and signature page of current US passport.

    2. copy of current marriage certificate

    3. Spouse never married before marriage to me, so nothing here. Checked application no prior marriages for him.

    4. Documents referring to you and your spouse:

    three years joint tax returns - planning on sending. Is this right?

    joint bank account statement

    joint property deed

    official birth certificate documents of two children we had together

    5. Proof that my first marriage in Russia ended in divorce way back when.

    So, is the above all I need?? How should I prepare the packet to the BCINN? Should I send a cover letter outlining all the documents I/we are sending?

  9. PERMANENT BAR for an overstay? How is that fair? Think about it.

    Interesting that this permanent bar doesn't apply to the illegals. They are about to receive, yet again and to no surprise, preferential treatment. This sort of thing is just outrageous. And then they have the fcuking nerve to say to the American people that this ain't no amnesty. Crooked Bastards! :angry:

    ITs probably not going to pass anyway. If it does, just feel happy that it is approved now, because in 2009 the illegals will get amnesty, plus benefits, plus any other preference that this bill will not give them. Meanwhile, I'll continue to pay and my wife will continue to wait. By the way, its our fault for marrying somebody from abroad to start with. Remember, the govmint is here to help us.

  11. There have been a couple of K3's transferred to CSC ashleigh is one I can think of, Im not sure if processing has finished on hers and one other that I can remember but cant recall the name, again not sure if processing is finished. Both of those were due for 10yr cards.

    Is very very uncommon.

    We are married a bit more than 2 1/2 years now after wife came on a K-1visa. Never had an interview. Was transferred to California August 2006 (We were married November 2004). Never had an RFE. Had three approved I-131's.

  12. I noticed that NSC hasn't updated their processing times in almost 1 1/2 months. If there are any recent approvals lately does anyone know what dates? We've been waiting 7 months now and still nothing.

    I assumed you have your Biometric done, right? I am sure you will get your 10-year card pretty soon. Chin up. :thumbs:

    Vent away! We are still waiting for wife's AOS. Married November 2004. AOS packet received November 26, 2004. Transfer to California service center. No RFE's. Three I-131's approved. Three visits to h@ll NYC office. No help from congressman. No help from NYC s4cks service center. Waiting for FBI.........................bu%%SH*T!

    It would be nice if all the relevant information ie. this is what you can do if you are in FBI namecheck limbo were compiled and put on a sticky!!! We are still waiting since filing our adjustment of status November, 2004. The worst thing that could have happened to us in retrospect was transfer to California. The actually very helpful NY service center says they have no power to expedite anything in California except to send them a request, which always has gone unanswered. Congressman can do nothing also except say to wait another six months and then get back to me....................unfortunately, the joke is on us.

    nothing in this process is fair-some are approved in weeks, some years. There is no rhyme or reason to any of it!!!!!

    There are older than my wife and I. However, we are getting up there................AOS received November 26, 2004; Transfer to CSC August 22, 2005. Two sets of fingerprints. Two I-131's approved. Third one filed recently. Three trips to the local BCINS headquarters. One congressional inquiry. Nothing resolved. Never an RFE. Pure boolshit!

  15. i dont know what to tell you other than make an infopass appointment. certainly its out of the norm as you know.

    Two infopass appointments at the mother h$ll of all BCINS service centers at NYC lead to nothing other than re-fingerprinting. Now we are on our third AP, which we will hand file in the NYC service center as per their instructions at our INFOPASS appointment (let them send it to Chicago if need be) as our application continues to be "pending" at the California Service Center.

    oh gosh stacy... im sorry to have to welcome you to our corner. I hope your stay is short.

    This thread should always stay high up. At least you all had an AOS interview. I wonder how many are like my wife and I having AOS November 26, 2004 and then never even interviewed and never received GC like most people these days do without an interview?

    Has anyone out their got a logical explanation for the randomness associated with the BCINS ie. does not seem to matter what country your spouse is from when it comes to who is hassled by the BCINS? I always thought we were unduly hassled because my wife is from Russia. After reading this board I believe it was just a random event that unfortunately happens to different people every day for no reason what so ever. Any thoughts on this?

    I am on my third one now. You just copy your visa on your passport, information detailing who you are on your passport and immigration card which has your A number on it. I always had a flight paid for and talk about visiting relatives in the body of the letter when I applied for my wife's I-131. Attach a copy of fingerprinting and copy of I-485 with the application. The only kicker is the application now calls for 3/4 face photo, while if you call the 1-800 number they tell you two passport photos is ok.

    I called the 1-800 "information" line. The lady there says disregard the 3/4 face photograph. They are going with a full frontal photo for the application ie. passport photo. Enclose two with the application.

  18. No lawyer can speed up the process :) It's the same speed regardless of how you file...

    My experience is you need a lawyer to get your through the AOS. I put in the K-1, no RFE, wife got approved in five months back in 2004. We were married and I put in our AOS packet, again no RFE, but she did not get her green card as of today and they have her on an FBI name check wait with a pending application 2 1/3 years later. If I had a lawyer when I filed the AOS perhaps that would have gone better..........................................

  20. What is FOIA reguest? How to make it? Is it to write somewhere or to call?

    I am very new to it.

    They told me they will tell nothing about a case status, there is tremendous backlog etc. ie. no soup for you! FOIA stands for freedom of information act. You can write them under FOIA and they will have to give you information about your case. Unfortunately, they have the ability to determine how quickly they have to respond to your FOIA request.............................
