AOS interview successful, but waiting for FBI name check

My wife had her AOS interview March 8th and was told that she was successful, but final approval was pending for the FBI name check.

Are there others out there in the same position?

Do we have an average for how long they take to complete the task, or is it another one of those cases where we just have to sit and wait until it happens?

Background checks can take as little as 30 days to 2 years. There's no way of finding out where in the process you are and hwo much longer it will take. If you ask your congressman to inquire, they'll turn you back because there's nothing they can do either.

The reason that it takes a long time is depending on your cuontry of citizenship and birth, if the country does not "cooperate" with the US, the FBI and CIA have a difficult time conducting a name check (see if you're on any terrorist lists, wanted by any country, etc.).

All you can really do, unfortunately, is sit back and wait. I have read in some cases where a check was pending for 2+ yrs that someone formally sued USCIS and the background check got expidited. That sounds like a bunch of trouble though.. :unsure:

Timeline

Security checks have no time limit so there is no timeframe. Depends on the number of checks and some are cleared early but they expire before the others ever get approved and are reordered. I am in checks and you will just have to wait the processing out. Pray for patience and good luck.

If it makes you feel any better, I had my interview done on November 2005 for AOS and got a verbal approval. As of now there is no sign of the ###### GC.. I am lucky that i have a H1B to work with.. But it can be a real pain. I already called those INS ####### 3 times to follow up on my case. Nothing seems to have worked. My name is still stuck at some clerks desk.....Oh God..

Congrats on the interview. Hopefully the FBI check won't take too long. I thought I read some new policy where the FBI had to have these completed within 120 days. You might try searching the USCIS site for this. Good luck

I posted this the other day http://www.visajourney.com/forums/index.ph...071entry82071 ...unfortunately there is nothing much anyone can do about the FBI clearance except wait....I am going to send Carina (k-2) with her Mom (K-1/approved AOS greencard in hand) to an infopass appointment if we haven't heard anything by June when she gets out of school; by then we will have waited 7 months for the namecheck to clear.

Pretty much hands tied. It doesn't seem like there's much to be done, and what's worse, you probably can't contact the FBI to expedite or ease the process along. Heck, even if you obtained your records from your home country for them, it might not do anything!

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.

Apr 25, 2005 - status inquiry since AOS is 90 days overdue

May 2, 2005 - status inquiry letter to Houston office

May 19, 2005 - had a meeting with the ICE ( they said they didnt know I filed for AOS???)

July 7, 2005 - sent a letter to Senator, Missouri Cis, CIS Ombudsman

July 27, 2005 - letter from Ombudsman - they will start an inquiry into my case.

Sept 14, 2005 - receieved a letter from USCIS Houston that I need to contact Missouri ( from status inquiry)

Oct 6, 2005 - fingerprinting- EAD

Nov 15, 2005 - Received letter from CIS Ombudsman-I need to contact the Houston USCIS

Nov 17, 2005 - Received AP and Ead in mail

Dec 28, 2005 - fingerprinting- AOS

Feb 9, 2006 - Aos interiew- still waiting for background check

Nov 3, 2006 - Second AOS interview, still waiting for background check

Nov 3, 2006 - I-130 approved

Dec 2, 2007 - Fingerprinted again..third time for AOS

Feb 14, 2008 - Received email case approved

Feb 26, 2008 - received Green Card

I almost started a thread with this same question today. We interviewed March 9th and were told the same - waiting on name check. We were told not to panic if it took longer than 90 days - nobody said anything about waiting 2 years. We were also given an e-mail address that we could use to check the status.

Later that day we met up with another brit/us couple. She interviewed in November 2005 and was told the name check was not done, but had her green card 10 days later.

I think it might be helpful to keep this thread up to the front so that those of us presently waiting could keep tabs on one another.

The e mail address we were given was specific to the Pittsburgh Office.

I should add that we were also told this situation is not uncommon. Our officer (who was a great guy) said that processes are continually improving (witness the fact that our interview was only 4 months after filing) but that not all the improvements are keeping pace with one another.

Well i'm waiting as well the adjucating officer told us there's no reason we can't be approved bec. we have all the necessary papers except they have to wait for biometrics/name check so we have to wait for 2-3weeks but i got my welcome letter to US last sat. So still waiting for the card and my status was not online anymore. I'm sorry that u have to wait long. Goodluck!

We've been waiting since September 2005, it's been 6 months. Last Wednesday, we made an INFOPass appointment to check the status and we were told our file was returned to USCIS the day before. We just have to wait for a decision. So hopefully we should receive good news soon.

as a matter of fact...we are also waiting.

we went to our info pass apt. today and they said sorry nothing we can do to speed it up. some people wait 3 years. congressmen and state reps. cant even help u out in this. u can try but im sure it will be no use.

he did say they were sent 2 days after our interview.

#######....i thought they were sent in a year ago when he had the biometrics for the aos application!!!!!

we have been waiting 2 months and no green card yet.

We have been 14 months since they were sent to the FBI and 11 months since his interview. There is nothing to do but wait believe me, even a senator cannot move them. Yes he is from a North African country but I saw someone else on this board with a long wait from Scotland, and someone else from Morocco who got theirs right away so it doesn't make much sense.
