  1. Hi everyone,

    A general question regarding the timeline of filing I-751.

    My conditional green card is going to expire on July 28, 2013 and is preparing for removing the conditional green card through filing I751.

    According the description of When Should I file Form I-751 under "Instruction for I-751", it says "you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. THis is the date your conditional residence expires." Applied to my case based on my understanding, I only only apply after April 28, 2013, which is 3 months before the expiration date. But I need to do so as soon as I can after that date (Apr 28, 2013). Am I correct?

    Another question, after I file I-751, generally speaking, how long should I get my new permanent green card, a month, or two? Dose it require any interview? Many thanks.

  2. Hi Everyone,

    Got my conditional green card on July 28, 2010. It is the time to file I-751 to remove that condition. I read through the "Instructions for I-751" and prepared the following items to be filed together with I-751. Just want to get some expert opinion if they are enough or I am missing anything important.

    1) Filled I-751 (believe that is the only form that I and my wife need to fill and file together, no other form required.)

    2) Initial evidence:

    1. a copy of my permanent resident card (both front and back sides)

    2. evidence of relationship:

    2.1 birth certificate of our first child;

    2.2 lease of rental apartment;

    2.3 joint bank account;

    2.4 pictures togther

    2.5 affidavit letter signed by two other people;

    any other suggestions?

  3. I am a green card holder and plan to enter US in Jan, 2012 which is my first time of using green card to enter US. However, my china passport will expire within 6 months, (actually, it will expire in May, 2012). My concern is if this will bring me any trouble to enter US since when I am a student (F-1 visa holder), US custom does require a valid passport with a validation period longer than 6 months to enter Us. Many thanks for any help and information on that.

  4. Thank you everyone. Thought about renewing in China, but I will only stay in China for about 10 days while the whole renewing process requires 18 work days. So far, it seems that I have to renew it at chinese embassy in DC (no mail service, so I have to be there in person). It is not so convenient, but have to get it done! But just don't know if embassy receive my application while my passport is still valid.

  5. I have a small thing that I need some clarification. I just got my green card and plan to come back and visit my parents in China. I am wondering if green card plus my passport is sufficient document for me to come back to USA. And my passport will expire in May, 2012 and I kind of remember that US required a 6 month or longer valid passport to re-enter. Is it still true? Many thanks.

  6. That is the part I have the most concern. If I ask for permission to accept employment, but later you disclose you have a previouse EAD through OPT, do you give them a sense of cheating, even though they are under different category?

    No, you put "permission to accept employment." As Little my said, it is NOT renewal, because it is a whole new category. You would disclose the OPT EAD in the relevant part, yes.

  7. That is what I thought too. But for the first question, "I am applying for:", what should I tell them? I guess I should check the box "Renewal of my permission to accept employment (attach previous employment authorization document)". And under question #11, say yes, since I do receive a EAD through Vermont Service Center last year which is under OPT. Am I right?

    The I-765 will not extend your OPT - you will be issued an EAD under the AOS-category, which has nothing to do with the OPT. So you are not renewing your EAD, you are getting a new one.

  8. My case: came to USA as an F1, applied for OPT last year and OPT period is going to expire on August 31st, 2011.

    Got married in Oct to a USC, and filed AOS on Mar 23, 2011. NOA-1 was accepted on Mar 28, 2011.

    However, I am still waiting for biometric appt after almost 1.5 month. Sounds normal? By the way, I called USCIS customer service number: 1-800-375-5283, but I could not speak to a representative, any help?

    I am going to file I-765 since my OPT will expire while my case is pending. But I have a concern about it. If I say I would like to renew my EAD, does it mean I want to extend my OPT. But my OPT cannot be extended for another year because of my forestry science major. Or application of I-765 will give me a new EAD under a different category. Need some suggestions.

  9. I am waiting for my biometric appt for almost 1.5 month since I filed AOS. It varies a lot. Don't worry. By the way, which number do you call USCIS. I call 1-800-767-1833, but I could not speak to a representative. Any help?

    Hello everyone, Just a quick questions and its kind of hard for me to really find out what's going on.

    I have filed for my AOS Nov 12th 2010. Biometrics was on 1/26/11. Already received EAD and AP.

    It's been about 1.5 months since biometrics and I haven't received any interview letter yet. I have called up USCIS and spoke to the customer service there and the lady told me that the I-130 could take up to 5 months and the I-485 could take up to 1 year. She said that my application looks good and is "pending".

    I just find that a bit odd since most people on VJ seem to get their interviews within 3-4 months of filing.

    I am wondering if anyone on VJ lives in the NYC area and what the most common timeline is like.

    I saw your case, and field office in NYC shows that they are only processing case in Sep 2011. But how is your case so fast according to your timeline? Within a month, you already got your biometrics done. But I have not received any thing within over a month.

    I did not file my I-765 with my AOS since I thought 5 months were enough to get my green card. But now it looks not true. So I have to apply or renew another EAD. Should I say "renew" on I-765? Many thanks.

  12. My I484 was filed together with I130, where my wife is the petitioner and we are now living in GA. However, when I check USCIS website, it shows that processing time for I485 at Atlanta field office is only processing cases from August, 2010. It means my application has to suffer a huge delay, doesn't it? Or I am in the wrong place to check the processing time. Many thanks for any suggestions.

  13. My I485 was accepted on Mar, 28, 2011. However, the time processing for Atlanta, GA field office showed that it is only processing case at August, 2010. Before I got green card based on I-485 family base, my OPT will expire in August. As a result, I decided to renew my EAD card by filing I-765. However, my major (Forestry Science) does not allow me to renew my OPT under the same category. Or USCIS will issue me a new EAD. Any suggestions on that from experts? Many thanks.

  14. I130 and I485 were received on Mar 24, a notice of reaction was issued on Mar 28, 2011, and we received the letter of notice of reaction on Apr 6th. However, over a month, we have not received any an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. Is it normal or we should expect a longer waiting time? Thanks for any help.

    Another question, I got my citizenship through naturalization, do I need to attach my birth certificate from Hong Kong in my file?
