  1. I hoped that someone with a more definitive answer would respond to this question. All I can tell you is that when I went for my biometrics appointment today the officer told me that I could have had it done anywhere in the US. His words were "as long as you are not outside the USA ..."

    Is someone going to send your NOA1 to you? You will need it in order to get back into the US once the green card has expired.

    Yes, we will have the noa1 sent back. So just that paper and his expired greencard works to get back into the U.S. I guess I will just wait for the biometrics appt. and then call them and ask to reschedule or what my options will be.

  2. We got our noa1 today, which basically just says howmuch we paid and that his greencard is extended for one year while we are completing the process. We didn't receive a biometrics appt yet. I'm a little nervous about this, did you all receive biometrics appt. in noa1 or did it come in a second noa?

    Also, I'm currently pregnant and we decided to deliver the baby in India due around Christmas, we left a few days ago from the U.S. and don't plan on returning until she is 2 or 3 months old. Does anyone have any info on getting biometrics done at an embassy abroad? Or will I just have to change the date to April 2014 when we return to the U.S.?

  3. If your file was transferred to anywhere other than your local office for an interview you would have received a notice from USCIS to that effect. Since you didn't receive a transfer notice but did receive an interview notice, your file was not transferred out of your local office. The Chicago address is kind of like a clearing house. All of the applications start there and are quickly reviewed to make sure the obvious forms are there and signed and the cheque is correct. The packages are then forwarded to the local USCIS office for review. The local office does a quick review and if it looks like it is a straight forward case (as most K-1s are) then it may be transferred to the California Service Center which generally means they are reviewed and approved without an interview or if they are not backlogged may approve the case themselves. If the form is later sent from California to another office and especially if it is sent back to the local office, that means that the reviewer at CSC has recommended interviewing the couple. Interviews are done by the local office. You would receive a notice of this second transfer.

    thanks so much everyone. How the heck do you all know this much???!! Well I hope this interview happens fast as we were trying to head back to India for a few months and didn't want to leave and then have to fly back after 10 days.

  4. We only submitted in August our I-485 petition but stil annoyed that our case keeps getting transferred

    We sent it to Chicago Lock box. then he was called in for biometrics in Cleveland where we live.

    Then case transferred to Missouri then transferred california in mid October. Then case transferred again nov. 8 to some other office in california, then transferred Nov. 14th to Missouri.

    anyone have all these transferrings going on??

    YOU GUYS NEED TO STOP HELPING HIM. IT SOUNDS LIKE A FRAUDULENT CASE AND IF HE IS HONEST IT WILL GO THREW. LEAVE HIM ALONE. i DON'T WANT THESE SCAMS COMING TO THE U.S. THIS IS WHAT MAKES THINGS SO DIFFICULT FOR ALL THE HONEST PEOPLE WHO REALLY DO FALL IN LOVE WITH FOREIGNERS.

    call and call and bother them. go in person. cause a ruckus. you have to get the info needed. this is ridiculous. did u email VFS?? if the american is in india they can go make an apt. for the embassy and then go and talk to someone at window j24 or j25 and ask what happened. first you will have to go to the u.s. side then make sure a security guard escorts you to the lady who will give you your number, or if u have been to the embassy before and have confidence go ahead and just do it yourself but you need to know where to go.

    WARNING that fat #### blonde lady that works in the middle window of the u.s. embassy on american side is a ######. she will not help you and is really annoying. when u enter the american side try and go left behind the secruity door and speak to someone in CIS but generally no one is there. they will more then likely make you go to ACIS and then just make ACIS send you to window j25 make up something like they told u to go to that window. then you have to walk back out and head over to where the interview was taken. i think interview is taken at j22 window or something like that but that window wont talk to you. u have to go to j25 window. a younger girl with long curly hair is pretty helpful and nice. you have to be confident with them. DO NOT LEAVE unless u get the info you want. insist upon it but diplomatically, not like a psycho bc they are still processing your file and you dont want it denied.

    Most aliens need Advance Parole to re-enter the U.S. after traveling abroad who have pending applications for immigration benefits or for changes in nonimmigrant status.

    Any adjustment of status applicant who leaves the U.S. without advance parole is automatically considered abandoning his/her application for adjustment of status. Such a person will generally not be allowed back in the U.S. The person would have to do consular processing while remaining out of the U.S.. This applies traveling to any place outside the U.S., even going to Canada (even Canadian Niagara Falls) or Mexico or places like Bahamas.

    You must apply for advance parole before leaving the U.S. If you depart from the U.S. or attempt to enter the U.S. before a decision is made on the application, your application will be considered abandoned.

    Separate application forms, fees and sets of documents are required for each applicant (including yourself, each of your family members) who needs to travel.

    Application fee must be sent with the application.

    There is no biometric fee.

    If you are in the U.S.,

    A copy of any USCIS issued document indicating your present status in the US; and

    An explanation or other evidence showing the circumstances that warrant issuance of an advance parole document (not required in next 2 circumstances described below); or

    If you have already filed for an adjustment of status (I-485), a copy of I-797 Notice of Action, receipt of filing I-485.

    If applicable, a copy of the I-140 receipt notice and copy of the I-140 approval notice.

    If you are in refugee or asylee status in the U.S., and you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter

    Copy of your marriage certificate, if you are applying for advance parole based on pending green card petition of your spouse.

    Copy of the child's birth certificate if applying for advance parole for a child based on pending green card petition of the primary applicant. If i have missed out anything i am sure the VJ elders will assist.

  8. We just got our k1 fiance visa approved! yippee!

    Now we are waiting for the passport to book our tickets to the U.S. Is it possible to leave the U.S. immediately after getting married? Even entering into Canada that's 2.5hours from my house in Cleveland?

    Trying to figure out if we can plan a trip to Mexico or Canada. I also have some work in Italy and want to know if my future husband would be able to come with me or can he not leave the country. If he can leave the country then for how long?

    Does anyone know the answer and if so, is there a website that I can read the information directly from?

    Do they go to the house of the person who is not from the U.S. I read they do a background check on every place they have lived since age 16. Do they send information to the home? Because we are leaving for 2 months (well one month is gone already).

    Also, how do you know when your noa2 is done? I read some people say they never saw it online, it always said "initial review" and some people say they did not get the hardcopy.
