  1. Hi Folks,

    So happy I got my biometrics appointment today!!! according to everybody else timeline my case is going with no delays.

    It's dated 03/13/15 and original appointment date is 04/01/2015 in the morning at ASC Oakland Park, FL.

    I'm going to try a walk in this monday!!!

    Any tips besides bringing this NOA and Photo ID???

    What if they ask me why am I trying to walk in besides waiting for the original appointment date?

    Last week I made a question asking if biometrics it's intended for Work Permit and now I certainly know that yes. It says case type I485 and I765.

    We also went early to the Oakland Park ASC. The young woman just asked for the interview document and stamped Biometrics Procedure with the date. There was no line and she said they are usually not busy. It took us only 10 minutes to get in and out. Bring your NOA and Passport, that was all that was needed. So you're getting the biometrics for EAD and Green Card. I think it will be ok at Oakland Park, especially since it is not so busy as other facilities. Now the social security office on Commercial Blvd is a nightmare. That will be a long wait, so be prepared for that. Good luck to you.

  2. If you have trouble getting a B1/B2, then you certainly won't get a K-1 Visa.

    Are you telling me a USC cannot marry a UK citizen in the UK or anywhere else?

    Point of clarification, getting a K 1 visa is different from getting a tourist visa (B1/B2). To get a tourist visa for many non visa wavering countries is a difficult process and there are many rejections, but a K1 is much more attainable when a US Citizen or permanent resident is apply for that individual. I had relationships with two women who could not get a B1/B2 but were able to get an approved K1 in 5 months.

    For what it's worth, we submitted my husbands tax returns for 2011, 2012 & 2013 - he had not sent the 2014 taxes at the time I sent the packet.

    His income was stable for the past 3 years, and all earned here in US - so maybe more straightforward than Meghan's situation with foreign income? I don't know.

    No RFE for us yet. Maybe depends on the officer like Leo suggested?

    I also submitted my taxes for years 2011, 2012, & 2013. I also included my work payment stubs (2 months worth) and my offer letter from my employer. 2014 tax returns are not necessary, especially at the point where we filed in February. I have not received an RFE and I don't expect one, especially since I did the exact same thing when I had previously filed an I-129F which was approved with no RFEs.

  4. Hi. Just wanted to ask you or the other people here that received biometrics appointment if they received like a text/email notification when appointment letter was sent so you make the idea that you are receiving letter soon on the mailbox.

    We only received a text when the first set of I-797C was sent. We didn't receive any text notification for the Biometrics. We looked in the mailbox everyday after the first notification. :-) I hope that helps. Good luck to you.

    I just wanted to update you all on the Biometric appointment. We received our notice of action, I-797C for the ASC appointment, on Friday, March 13, 2015. Our appointment date was schedule for March 24, 2015. We took a chance and went early (actually went today) on March 17, 2015 and was allowed to take the biometrics. :-) Happy St. Patrick's Day. The luck of the Irish was with us. :-) So hopefully that actually translates to saving seven (7) days off of processing. Good luck to all of you.

  6. Codeblue, I got an ITIN for my husband 2 years ago so we can file jointly. All you need is a completed tax return (leaving the spot where you would put the itin blank or write in applied) fill out a W7 and submit with your tax return...take all completed documents to your local IRS office with your id's and marriage cert and they will submit it for you and you will receive an itin in the mail.

    Thanks Chewy, it looks like I will do that or else ask for an extension. I just hate going into Miami's IRS office. The line is forever long there.

  7. Don't understand why you think this AOS process is holding you up from filing your 2014 tax return.

    Final filing date for 2014 tax return is 15 April 2015.

    You aren't going to have a green card by that date, and probably not even an EAD/AP card.

    And neither is needed to file 2014 tax return.

    Hello Leo,

    I also thought the same as you and I went to the IRS in Miami (January 2015) to get a Tax Identification Number (TIN) and the IRS representative told me that I could not get one unless I submit my current year tax documentation and supporting documents for marriage and identification. I explained to him that the rules did not say I needed to do this and the TIN application form instructions never mentioned this at all. I explained to him the whole purposed of this was to be able to file my our joint tax return for 2014 electronically. He said that in his computer it tells him that I need to comply with what he originally told me to do. We can come back when we complete our 2014 return and submit the TIN application with the tax submittal in the Miami office, then the Miami office will review, assign a TIN and send it to the main office.

    Well, I was a bit surprised by this and so we left without getting anywhere. I can always get an extension if I need it. I don't owe any taxes, so I am not worried about filing by April 15. I suspect I will have the EAD sometime at the end of this month, if not, I'll get an extension. I was not sure what to make of this guy. I thought he was wrong, but it could be that I do not understand their internal procedures. Nevertheless, good luck to everyone. It is definitely a journey.

  8. We filed on February 23, 2015 (Overnight Mail) and got the electronic confirmation of receipt for the 797 on March 5, 2013. I have updated out timeline. In our filing we are transitioning (Adjustment of Status) from B1/B2. We filed the I-485 (Adjustment of Status), I-130 (Alien Relative), I-131 Advance Parole), G-1145; I-765 (EAD); G-325A; I-693 (Medical Examination) & I-864 (Affidavit of Support) in a concurrent filing. Not sure how long the process will take, since every case is different. I am hoping that it goes by pretty quick so I can electronically file my taxes. Good luck to everyone!

    I have a question for the membership. I have prepared a concurrent filling package of the I-485, I-130, I-131 & I-765 with corresponding evidence that is required with an immediate relative (spouse) family based petition. I have followed the forums assembly of the concurrent filling of the I-485, I-130, I-131 & I-765. My question is do I also have to submit two separate checks or can I combine it in one check for payment to DHS? I would greatly appreciate your response. Thank you and have a good day.

  10. For the original poster, I have somewhat the same situation as you, with one exception. My fiance and I had an already approved K-1, which she did not use in 2011. We will be going to Cancun next week, and she does have a stop in U.S. She applied for a transit visa, and had documents to prove she would return, plus she had her airline tickets and the hotel receipts (they tell you not to purchase tickets prior to approval). I used my miles and put everything in her name. If she would have been denied, all would have beeen refundable. She went to her interview and she said the only thing they asked her was about the approved K-1. They didn't ask to see any other documentation. They approved her in about 5 minutes and told her she would receive her visa in 2 to 3 days. So when she comes through the U.S. port of entry, her transit visa will be good for 29 days and allow for continuous travel to Cancun. We did this trip so we could see each other, because my work schedule will not allow me to be gone too long and too far away. This way, if something happens, I can get on a plane and get there in a matter of a few hours. We will re-file the I-129F when we return from Cancun. So, we can wait for the process to be completed by then. I wish you both good luck and much happiness and love.

    It has been awhile since I have been active on this sight, but I have a question for the group. Long story short, my ex-fiance and I are getting back together. We had an approved K-1 from Moscow, prior to calling the relationship off in the spring of 2011. Now March 2013, we are taking a trip to Cancun, Mexico. Yesterday she got an approved transit visa from the Embassy in Ekaterinburg, Russia to come through the U.S. and transfer on a connecting flight to Cancun. I made the flight arrangements and this was the most affordable way for me to arrange the flight, plus I wanted to be on the same plane to Cancun. Nevertheless, the transit visa is approved. My question is on the return flight back Cancun to Moscow, if the return tickets are not continuous transit (has a layover of a week), would she still be allowed entry (POE)in USA? The originating flight for the first day of our trip is continuous transit, but the return is a a flight from Cancun to USA, then wait a week, then fly to Moscow from USA. I know she will need to submit an I-94, but will CBP on first entry grant the entry to USA if they see the second half of the trip is not continuous? I will actually be in the airport waiting for the flght to Cancun when she arrives, but will not have access to CBP at the POE. Any help or sugesstions would be greatly appreciated. And NO, we are not planning to get married on this trip or even attempt to change status. We will file the proper documents after she returns to Moscow. Thanks for your assistance.

  12. I am a U of H grad. Rice is a fantastic university. Most people try and fail to get an offer from there. They are smaller and have to severely limit their enrollment. I asked my Nephew to try for that school and he is doing all the right things to be able to.

    Well at least Rice has a good baseball team. :-) I just moved back to Houston from Austin. Glad to be back in the big city. :-) He'll be in good hands over here Gary, no worries. :-)
