  1. here is the official response from USCIS http://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-3481/0-0-0-4484.html

"© Marriage Between Close Relatives .

In some foreign countries, and some states in the United States, marriages between close relatives (e.g., cousins) are permitted under certain circumstances. In cases where such marriages do not offend the laws of the state where the parties reside, the marriage will be recognized for immigration purposes. "

  2. The best thing is to know what the law states rather than what others have done. Asking others not to tell you what the law states is knowingly refusing right counsel. While others who had been dishonest may not have had any repercussions from not mentioning it, you may. It is better to be honest about it than rely on the action of those who knew better but may have chosen not to do better. It's best not to feign ignorance. Be honest and let them know. Don't count on others to be your conscience based on what they did. Also, if you had gotten a 2 years conditional when you should have gotten your 10 years GC what would you do? Keep the two years or return it for the correct one? Think about it. It's a no-brainer. Be honest and let them know. Return it.

For "right counsel" I would go to an attorney not to a website. Taking responses here as "right counsel" is more dangerous. I take read this site for anecdotal value not for legal advice.

  3. Think of it as going to a job interview, being hired, and while being guided to the door and shaking the hand of the interviewer you are asking for a payday advance.

mmm... not quite, the analogy would be asking for the job offer in writing on the spot... at my workplace they would only mail you the offer letter after everyone involved has signed off, other employers can do it right away. So, no, it doesn't tantamount to asking for money in advance. It doesn't look bad to ask.

  4. http://www.dhs.gov/xlibrary/assets/statistics/illegal.pdf

Columbia is 11th on the list of the top twenty countries of origin of illegal immigrants. Should the US not be concern about this when assessing the presumption of illegal immigration when Colombians apply for visitor visas?

I understand this is a generalization and may not be the desire of the father. This is why there is a process to weed out those who may abuse the visitor visa.

This white paper is from October of 1996... 15 years ago... last century. While the statistics withn regards to undocumented population orginally from Mexico most likely remain the same (due to geographic, economic, political, and other reasons), Colombia and other countries are different from 1996: i.e. in 1996 Colombia was facing the bloodshed of the drug war that today is more typical of Mexico. I am sure conditions are not great now and most likely Colombians still might make significant portion of the current undocumented population, but I would not base that "fact" with statistics from 1996.

  5. I sat with a congressional liason of my Senator's office. She "explained" to me that the Service Centers bundle the petitions in packages... they move pallets of petitions and they just sit there while those pallets are assambled. And that some times adjudicators are just waiting doing nothing while the new pallet arrives, so they pull whatever is handy (more recent files) to work on that... (Never told how the new file skipped the pallet assambling process). When I said, "well, it seems it would have been better to wait and file in late january for a faster response." She said with a smile "yeah, right?"

I that point I gave up.

  6. i have emailed my senator twice with no response. not going to get help from them until i get home and can call them. i have always heard that if you are denied for a k1 visa there is no point in getting married and filing for marriage visa as getting married proves nothing.

If you have access to internet you might have access to Skype, if you put calls to the US on Skype are around 0.015 per minute. I would try to get hold of a human being while still there in case the file can get turned around. Who is your Senator? (truth is some are more responsive for these kind of cases than others).
