Looks like you may not have had a visa at all when you entered.

http://www.shusterman.com/245i-faq.html

Well when i entered the USA i know i did have a visa, i think it was before i got this "SECTION 245". I'm starting to think i'm just going to have to wait for my green card... which could take forever

This is probably also why i need a I-512-L for vacation everytime i leave the USA.

Can't your parents tell you what the visa was?

Yeah i'll look into it tomorrow since its late right now.

I checked my mom's old passport and her visa was a K-1...So the visa that i was under up till end of 2004 was a K-2.

Apply for a EAD. That will help in the short term.

If you have already done 2 infopass appointments then try to contact your Senator/Congressmans office. You will need to fax or send them permission to look into your case.

If i apply for an EAD and it gets accepted how would i go about applying for a SSN?

So i told my mom that we should send a letter to our Congressman and she said that we already did about 5 months ago and no reply from them! We are probably going to have to send another one. Should it take this long to get a reply from them? :help:

ps. again sorry edit is gone >.<

Try all Senators and congressman. Phone and speak to their immigration liason, most have one. They will not just look into your case without first having your written permission. Check out their websites.

It will take approx 90 days to get a EAD then you take that to the SS Office and apply for a SSN.

One more question.

I'm not sure if i did my interview yet. 2 years ago we went to the immigration office and we had to wait a while and after that me and my mother were taken in an office. We were under oath and the person had asked us a few questions. After everything was ok, my mom got approved and she got a stamp in her passport that was good for 1 year. She got her green card about 4-5 months after. I was also approved but since i turned 16 on the day of the appointment i had to be checked out for background stuff. Now was this the interview?

I think it sounds like it was the interview. I'm sure someone else will clarify just to make sure. :)

I'm not sure because don't they do name checks before interviews? But it must of been the interview since my mom got her green card right after and she even got that stamp. I was approved but no stamp or gc because of the background check.... -still waiting-

edit: maybe i did get that stamp... i don't remember =x

Yes they do namechecks during the process of AOS, your mom's namecheck must have been back and completed thats why she would have gotten approved and received her greencard and stamp in her passport. You should ask your mom if you got the stamp or not.
