Assume you are referring to the "Capacity to Marry." This is issued at the US Embassy, and it is issued right away on the same day.

The marriagne license requires 10 days to be a legal marriage license. If you fiance was not there for 10 days, then the license would not be legal. Most offices will issue the marriage license right away (not wait the 10 days) if you pay an "expedite" fee, in the Philippines. However, that is not legal. Your fiance can also apply on one trip, and pick up the license on another trip, and that would be legal.

You cannot file for a marriage license without your fiance. He needs to sign the papers in person, and he needs to pick up the license no earlier than 10 days after the application.

hi wacky,

freddy88 is right! you nee to have 10 days before you can get married, me and my hubby got the legal capacity to marry the same day...and it took us not more than an hour to get it from the embassy... even if we wanted to pay and expedite our marriage, we were still advised to wait for 10 days... so we waited!

enjoy your days together while waiting, its worth it!
