Hi everyone,

I really need advice from anyone who has experience with US visa stamping after a criminal record.
In 2025, I was convicted of a Class A misdemeanor (criminal trespassing). It was a misunderstanding/mistake situation and I did not actually intend to trespass, but I was still convicted and it is now on my record.
I was working in the US on H-1B and then got laid off. My H-1B extension was pending but I cannot change status inside the US now. My immigration lawyer suggested I go to India and apply for an H-4 visa stamping there.

I am very scared because of the misdemeanor conviction on my record.

My questions:

When filling DS-160, should I declare the conviction?
Has anyone gotten H4 or H1B visa approved after a misdemeanor like trespassing?

If anyone has gone through something similar, especially with H1B/H4 stamping after a misdemeanor, please share your experience.
