How screwed am I ? Work visa and I-94 expired. Currently on authorized stay. Recently married a US citizen. What should I do? (DUI on record) Am I overstaying?

Yes I am aware and I know that's not what I am doing. Like I said earlier in the paragraph you quoted, we have been living together for a while. What I was getting at was I have more than enough documents to prove that the relationship was legit and not just for immigration - which is what USCIS is interested in correct? Not meet someone on a tourist visa and get married in 30 days. That's not what I am doing. The timing however was driven because of the uncertainty of my situation.

OK, you tell this to immigration officer.

 

Then he asks follow up question: "So if your employer based green card would have been approved, you wouldn't be marrying?"

 

What would be your answer to this?

My answer would just be what me and my spouse discussed, getting married next year irrespective of my employment based application. I don't know why you think I am not being genuine here. I have seen countless posts of people getting married within 90 days of meeting and they were okay?

I'm sure you're genuine and your marriage is bonafide. You're just framing things in a fashion that may trigger more attention from immigration. Of course, you always have to tell the truth.
