I am in EB-2 category and I wasn't to transfer my case to Frankfurt. But I am not sure if the queue/backlog is long.

My priority date is 17.05.2023

 

I am not presently living in Germany, but I could make it there in the next six months or so, with about one year residency.

Given you’d have to be resident/working/living in Germany for a while before Frankfurt would accept a transfer then it would probably be pointless as I’m guessing you’re some way in to the wait at Lagos? Plus you might get stuck in Germany due to AP if you’re from Nigeria, so that could be another lengthy wait, probably not worth risking.

 

When were you DQ’ed? Please do fill in your timeline, thx.

 

And when does your employer want you to start work? If they’re not prepared to wait for you to go through the EB-2 process then would they sort a temporary employment based visa maybe so you could get to the US sooner?

I don't know such it can be more than three (3) months of waiting before they will accept transfer. 

 

I actually filled in Germany, transfered to Lagos after approval. 

 

PD: 17.05.2023

Approval: 01.08.2023

DQ: Initially 01.11.223. But now 23.04.2025, because I added a new derivative beneficiary. I was told that my initial DQ would change due to the new addition. I have written NVC on that, but no response yet.

Current: in April 2025 bulletin 

 

Some have been current for almost two (2) years in Lagos without IL.

Why did you transfer to Lagos?

 

There’s no minimum time to be in a country for a consulate to accept a case, most just require proof of residency but can refuse if they wish - they’re not obligated to accept a case.

 

Yes, 2 years is normal for Lagos. Your DQ isn’t relevant as you weren’t eligible for a visa until this month anyway.

 

As above, when does your employer want you to start? If they want you sooner they may have to sort you a temporary visa. Is it a company transfer, maybe L1 would be better?

I transferred for family reason.

 

I am not sponsored by any employer. I applied via EB-2 NIW. I have no employer.

 

Yes, I know proof of residence is required for transfer.

Ah, I see, you said EB-2 not EB-2 NIW so I assumed you had a job offer. 

 

If you’ll genuinely be moving back to Germany and living/working there, then you can ask once you’ve moved.

Yes. I can genuinely move back using the opportunity card (visa). I won't do anything illegal. I am just trying to "count my cost" to be sure backlog is not much in Frankfurt. I want to target one year. That is initial visa I would get for opportunity card. Extension is based on professional employment in the exact field (I don't want to bank on that).
