Hi Everyone

I'll try to be as specific as possible so I can get the best help available out there.

  • I live in the Caribbean, I have a B1/B2 visa valid until after 2010
  • My boyfriend is a LPR in the US. We wish to get married.
  • He's up for Citizenship in 2009 (too long to wait to be married :)) :unsure:

  1. Can I get married in the Caribbean, travel and live with him in the US and then apply for LPR using the I-130 form?
  2. Does that mean that after we are married I can enter the US on my B1/B2 visa and leave every 6months (which is how long i usually get from Immigration) OR is there any other way to stay without leaving?
  3. If I do leave after 6 months what's the minimum time I need to stay out of the US before I reenter?

Any other options that I have not thought of are appreciated. (Yes i have also considered the work visa option)

1, NO, for 2 reasons,

  1. He still has to be a US citizen to get an imediate visa number for you inorder to adjust status, he could file the I-130 but it will take a few years for a visa number to become avalible.
  2. Using a NON-Immigrant visa with the intent to Immigrate is visa fraud.

2, No way to stay with out leaving, they may even deny your entry on the B visa, having a visa is no guarentee that you will be allowed to pass at the POE, you may be asked to show strong reasons to leave the country after your period of stay is up, having a husband living in the USA can be a problem.

3, Many have big problems at the POE when they see multiple entries on a visitors visa in one year.

It is best for him to obtain citizenship, and then apply for the proper visa for you.
