Has anyone received this notice before? We filed and have received a letter stating that my wife did not make enough to meet the poverty guidelines in 2006, which we knew would happen as it was only $12,500. However this year business has picked up and she is on track to make $18,000. My income could not be used as it was Canadian income only.

They have sent a letter stating that:

Because my wife did not make enough last year they won't accept the application unless we have a joint sponsor who did. That is not a problem, my mother in law is a attorney secretary and makes more than enough. However, can my mother in law be a co-sponsor?

Let me know. I only have 2 months to submit the changes.

Thanks as always, I know you guys will have a ton of information for me. ;)

You're definitely okay to have your mom-in-law be your sponsor.

We are sending everything in we can, my wife doesn't have a copy of her w2 from last year but has her filing info. So we are sending that. The main sponsor has her w2 so we should be fine I think, correct?

The IRS said it can take 60 days to send a copy of last years tax return which would put me at the 70 day mark for mailing etc which means there is only a 5-6 day window in my deadline to mail in the initial evidence. So that is cutting it a bit close for my taste. I'd rather get everything in we can now and not risk missing the deadline and having everything be void.

60 days? Usually you can go to your local IRS office and request your last 3 years of W2s and they issue them then . I have heard a few people say that but I could be wrong.

Brad, I would physically go to an IRS office. Don't let someone on the phone deter you from doing so. You might be surprised that when you go in person they give you a different answer.

We're going to go to the Santa Ana field office tomorrow to request documents as an emergency. If that doesn't work we will just file as per normal but try to get rush delivery. Considering the circumstances I think we should be able to.
