Timeline

Is there anyone else here who has filed a waiver with Montreal/Vermont and are waiting for a decision?

Married August 21 2004 in Nova Scotia!

October 19/04 sent I-130.

April 17/08 finally arrive back in New Orleans after 3 years and 8 months.

May 19/08 Perm Resident Card arrives.

July 24/08 Reapply for a new SS card with married name.

August 4/08 Baby daughter born.

Sorry, I can't answer that question, but wondering why, if the ban is over, you would need to wait on the waiver. It is no longer required.

I would get your Senator involved and maybe try up the chain at the embassy, the immigrant visa chief or Consul?

I received a waiver application at Montreal for an I-601 and also got a 212a, but haven't filed, instead I sent a copy of everything I had to the director of DHS/USCIS in Washington for an honest opinion of the facts as the reasoning for the waiver in Montreal was tainted by a COs noting in my file her impressions which were wrong. Hoping to hear from DC soon.

09/20/2006 - Sent I-129F

09/22/2006 - Received at NSC
09/28/2006 - NOA-1 (1-797C date )

10/02/2006 - Cheque cashed

10/02/2006 - NOA 1 (I-797C recieved in the mail)

12/08/2006 - NOA-2 in 79 days

12/13/2006 - NOA-2 hard copy recieved

12/26/2006 - Package recieved by NVC

12/30/2006 - Received by Montreal

01/22/2007 - Received Packet 3

04/16/2007 - Returned Packet 3

08/02/2007 - Received medical documentation

08/07/2007 - Received Interview date Aug. 9th

08/09/2007 - Received I-601 and 212 (not approved yet)

02/17/2008 - I-601 approved 212 abandoned

06/2?/2009 - New medical and passport and doc sent to Mtl

07/22/2009 - Recieved request for DS-221 and notarized letter of intent

07/31/2009 - Montreal recieves thier final requested doc.

09/01/2009 - Visa approved and mail out today

I am, 212, and for Montreal to reply to ANYONE...

So I was reading your signature/timeline have they made any new progress??

Sorry it's taken me so long to reply. We have goten no where with our waiver. It's really hard arguing a case when they wont listen to me. And it seems government workers really hate it when you point out mistakes. That is our obstacle, no one is willing to listen. I keep telling them that the I-130 has been approved another 5 times since it's second revival in May 2007 with the last approval being Sept 25 2007. However CIS keeps telling me that a waiver is necessary.

I ask what for and they say because we sent one it, and it's being processed. They can't give me an answer till processing is finished.

So I say finish processing it for what- CIS says overstay.

Me- I've already served my time for the overstay, why are you processing a waiver that is no longer necessary? Let me transfer you to.....

This has been my coversation with Vermont for the last 5 months.

I have a senator involed and even they get the run around. I keep pushing for answers and nothing until today. Today we founf out that our wiaver-which was no longer needed has been approved. YEAH CIS! stupid a$$es. However I am grateful. Now I get to wait another 6-8 weeks for the paperwork to arrive from Vermont and another few months for the visa to arrive from Montreal.

Ron, I hope you and Sharon get a resolution too. I'm sure your file with be delt with faster than at Vermont or Montreal, now that's it's in DC.

Thanks I hope so too, sorry you had to pay for something you never needed, that part sux, now try and get a refund, it ain't going to happen. I'm now preparing a package to send to Sharon's Senator. I hope your wait is a short one now.
