Our K1 was approved on January 4th. Received NOA2 in the mail just a few days later. Then on January 20th our case was approved again and received another NOA2.  No idea why.

NVC received our petition on January 26th. I called again this past Monday to see if it had been put in the system yet. That’s when I was informed that NVC had to send my case back to USCIS on February 3rd. He said my case wasn’t put in the system so they didn’t know why. He also said it’s been happening a lot lately where they’ve had to send them back to USCIS for certain errors etc.

USCIS just received it yesterday so now my status says that the department of state has sent it back for further review.

Has anyone had this happen? Or know why or what could cause this to happen?

I’m just waiting patiently now for the notice in the mail to find out what the heck is going on. If this is a USCIS error, this is criteria for an expedite, correct?

My case was sent to USCIS, then sent back, had to make corrections. More than likely, USCIS forgot to do something on their end.

Quick update:

Just spoke to USCIS. They said it was sent back for review due to a couple of review sections not being completed. So I said "Okay so what you're telling me is that our officer forgot to check off a couple of review sections?" She said it seems that way. So I then said "So what you're saying is this is USCIS error?". She got very quiet and didn't speak for a second then said yes lol.

She then proceeded to say it can take up to 180 days for resolution etc.  I said nope, I'm not doing that. Already waited a year and this is USCIS error so I will be putting in an expedite request.

It won't take 180 days, they just say that at USCIS, it will be a quick process, usually a month tops.

Maybe before it would only take a month tops. But there’s another couple in the same situation as me. Theirs was sent back in November. They still don’t have an update.

Last year, had the same spill about things taking 180 days, but it was like a month. The good thing is that USCIS will expedite the case, and it will go a lot faster on the second go around.

Well I hope ours only takes like a month for a resolution because that’s insane.

Quick update. I officially put an expedite request in today under USCIS error. They said I should get a response within 7 business days. I find that hard to believe but we will see lol.

Another update: Tuesday I did the expedite request. Wednesday USCIS emailed me requesting information on why I was requesting the expedite. So sent them the email explaining it was confirmed to me by USCIS that it was USCIS error etc.

Today (Friday) expedite request has been APPROVED!!!!

  • 2 months later...

jumping on this bandwagon.

in my scenario, our lawyer only spotted a mistake in the dates for the I-797 after the case was sent back to USCIS (annoyed that they did not spot this when the NOA2 was issued and waited so long). now here's to hoping it won't take a month for them to correct it and wait another 60 days for them to send it back to NVC.
