According to this whoever posted the last January 12, 2023 makes me think they moved to Jan. They also processed two more cases from 2022 that were pending according to the list whoever posted here earlier.

But honestly just have some faith, it’s so easy to fall into depression but hard to get out of it. Have some faith! When did DOS receive your cases?

Yup. There are, definitely, still bunch of pending cases from 2022. I at least know of 11 🙂

I'm glad to see more cases than I thought were adjudicated last week.  Really feel bad for those that have waited for 3 years to get a NF :(

 

My case made it to DOS Feb 2 2023, and I have filed a writ of mandamus on Dec 15 2023, so I'm hoping it's my turn soon - but discouraged to see so many NFRs.

Wait do you mean DOS received your case in Feb 2022 or Feb 2023? Because how can you file a mandamus for a case that is still within normal processing time? If DOS received your case in Feb 2023 the earliest you can argue they are late with processing is February 2024. Their own posted timeline is 12 months.

That's not accurate, unreasonable delay and average processing time are not tied.

I agree Feb 2023 is early… some are still waiting from Jan 2023

You cannot sue them when they tell you clearly that their processing time is 12 months. That’s ridiculous. You can only sue them once they exceed their own posted timeframe. I know that this is not what you would like to hear and that unfortunately the DOS can keep changing the processing time like a moving target, however, you are not entitled to a decision before the official posted processing time is elapsed. The DOS will most likely request the judge to dismiss your mandamus. curious though, who advised you to file this mandamus lawsuit so early?!

Timeline

I came to the US in 2017 on a J1 visa, but in 2020, I was granted a T visa due to being a victim of labor trafficking. In 2022, I faced challenges as I gave birth to my baby, who had health complications, and I personally battled sepsis. I've submitted medical and psychological evaluations, along with supporting documents highlighting my trafficking victim status and collaboration with law enforcement on the case. Do you think this makes a strong case for my hardship waiver?

Yes I think this qualifies as hardship. But you should definitely speak with an attorney
