Hi All

I am an Indian. My boyfriend is in America and we have known each other for 7 years and we studied together.We have been in constant touch.He is an American citizen and now e plan to marry.We want to be with each other asap.

We are ok to marry in US or india,we just want the process that would bring us together soon.

1.I m not sure whether K1 will be better for us or K3?What do u suggesst?He stays in Virginia

2. K1 says we shd have met in last 2 years,we have met but we dont have a prrof as such,just that he visisted india and we met.

3.K1 also states that we shd be engaged,what does this mean?it has been agreed in our families that we will marry and we have been in love for 7 years,does engasgemnt mean a cermony etc or just that u shd have an affair and be able to prove it.We have been inconstant touch oer phones and have exchanged gifts.We have proofs of that.

4.what would be he normal processing time for K1 and K3

5.If yiou think K1 is better then should my friend start the application right away?

6.Does anyone know a good attorney in Virginia?

Please advise us.

I second Dev, you should have a read through the guides up at the top and they will help A LOT.

1. Usually K1 is faster, but check the current processign times up at the top

2. We showed passport stamps into the country, photos, receipts etc. to show we were in the same place at the same time. Just think what shows you were together.

3. Engaged means the normal US version of being engaged. Guy and girl agree to be married. That's it. That's why you sign an intent to marry letter.

4. REad the processign times at the top

5. I would say make your decison on which visa and file soon. Filing fees go up by a LOT on the 30th. So yes, file ASAP unless you can't move for a while.

6. Most people here don't use lawyers and while a consultation with one can be helpful, you probably won't need one unless you have a complicated case. Search for this and you'll find LOTs on it.

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Direct consular filing does not apply unless your boyfriend becomes your husband and he lives with you in India for a while afterwards (6 months).

K1 are usually faster than K3. As others have suggested read the guides and processing times.

Sounds like you are already engaged, which means that the two of you have agreed to marry. If your culture provides for an engagement ceremony as some do, it is fine if you had one and had pics, you could use them as proof of having met in the past 2 years. It doesn't take much to prove that you have met if you actually have met. Just that his passport stamps and boarding passes have worked for others. Pics together are not required.

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.
