Hello,

I am looking for guidance for how to proceed. I filed the i-130 for my parents in April 2019 via mail. In December, I received an rfe for both (1 asked for birth certificate , the other for birth and marriage certificate (I had submitted them prior but I guess without the copy of the documents they were translated from). I responded to the RFEs in January via certified mail usps. According to usps, the rfe was received on January 27th. However, my status was never updated on the website. I have been calling since then and representatives gave me different answers from "received" to "I don't see them in our system". Our status was updated on March 15th saying " On March 15, 2020, we sent a request for additional evidence for your Form I-130.... The request for evidence explains what we need from you." After several calls with tier 2 officers and several status inquiries, who said they don't see any additional RFE's being sent to us, one officer told us that the rfe must have expired and that is the standard message. Again, since then we have called constantly and placed several inquiries and on one inquiry, we learned that "you indicated you mailed the RFE in January but we did not receive your response. Send the information again with proof that it was submitted" for just one of the two cases. After speaking to yet another officer, who said he doesn't see the RFE for either case, I mailed information for both, along with cover letter and proof of certified mail receipts" . Now, it has been 2 months since and we still have no additional status. I call every week, speak to officers and I have been receiving the same response since April saying "your case is with an adjucticating officer , expect a response within 60 days". Sometimes, the inquiry says it was responded to but I don't even receive the email... The last officer I spoke to said everything was received but there are no updates because our case is in the online system but our documents were sent by mail and are in a different system and not everyone checks there. He suggested to contact the senators office which I did but I don't have high hopes at this point in NY....

I am sorry for the long story but I don't even know where to go from here. One of the officers brought up that we may get an automatic denial but this is not at all our fault. What are our options? Can anyone offer suggestions?
