Hi all,

My fiance will be coming to the U.S. in a few weeks and I'm trying to get all the AOS stuff in order. Well, for the past year and a half I was in China volunteering at an orphanage, so I didn't and still don't have an income. That being said, my fiance, obviously, will need a joint sponsor. We used my grandpa as a joint sponsor for obtaining the K-1 visa and everything was fine. Now, my grandpa and grandma file their taxes jointly, so my grandma signed on the line with my grandpa on the affadavit of support for the k-1 visa. Will she need to do the same when we file the I-864 for AOS? My grandpa is the joint sponsor, but I mean on the tax forms you can't distinguish who's income is whose. And, both of my grandparents are retired. Now, my grandpa alone does have enough income to meet the requirements, but he put all of his pension from working before into the stock market. So, here are my questions, basically:

1. Is my grandma required to sign on the line with my grandpa on the I-864?

2. Should my grandma fill out an I-864A? (even though my grandpa meets the requirements using his assets alone, I just wanted to cover all my bases and show that together with my grandma they also have enough income coming in yearly.....or is this not necessary??)

3. If my grandpa alone without my grandma's yearly income does not meet the 125% poverty guideline.......but has very substantial assets that go well above the 125% poverty guidelines, will this be a problem? Will the government be subjective and say, "Well, he has enough assets, but his yearly income isn't enough, so he doesn't qualify as a co-sponsor?

You still do an I-186, and I believe you will have Grandpa do an I-864, and Grandma do an I-864A

No need for Grandma to do the I-864A if they file taxes jointly.

Well, I'm still confused because on the one part of the I-864 it specifically says for the sponsor(or joint sponsor in the case) to write down their "Individual Income" and that if other household members income will be used, then they need to file the I-864A. But, it's just confusing because the tax form filed does not differentiate incomes between a husband and wife who file jointly. I mean, in the end, if I'm still confused...would it do any harm to just have my grandma fill out the I-864A just to be sure?

It wouldn't do any harm, certainly. Actually maybe I'm wrong here, and the I-864A is needed. I thought I remembered that it was only really needed if seperate tax returns of people were being used to prove the income required, but I could be incorrect.

In the end its always best to do the maximum amount to avoid an RFE.
