Hi All

i dont know if you can get all information and our timeline from this post, but any way im jordanian and my wife Us. citizen and we reside since 8 months in Saudi arabia, in April 22 ,2007 we decide to prepare our I-130 and send it to the Us embassy here in Riyadh, Saudi Arabia

they approved the application and asked for the rest of the primary appointment ( G-325,Photographs, passports photocopies, marriage certificate, translation also)

also they asked us some questions like

1- how have you met

2- why have not you apply in US embassy, Amman

3- when will you resire from your job

4- are you going to the states to live forever or what

5- and another questions i'll provide as soon as possible

and they told us they will send our petition to the CIS in the US , so we have to wait for the approval, and before we left the embassy they gave us a package( i think it is packet 3) which contains

1-medical examinations

2- police certificate from jordan " GID : General Dept. of intelligence, since this the formal authority or department who is giving such a document the good conduct in jordan", i went to jordanain embassy here in riyadh and asked them for that document and they approved and will recieve it by 1st of june, 2007 since it takes a month

3- DS 230 part II Sworn statement

4- finacnial support " which is form I-864 from our sposor in the US

5- Educational Certificates

after one week the phoned me and said the approval has come from the US for your I-130 petition so you can proceed with your IV Package , i thanked them even they waked me up early to say so

now im a little confused about the Affidavit of Suppotr form I-864

1- who will fill that form for us? since i found that this form could be saved and send via e-mail so that our sponsor can fill it up and send it to us and my wife sign it as " Other than the Sponsor Preparer"

the question is , Is that applicable or the sposor should fill it up and print it out then notarize it from the responsible authorities their in the US

2- they asked me to bring the W-2 document and the tax return " a copy of those documents"

so is it applicable if our sponsor scan then send it via e-mail so we can print it out here in saudi arabia and staple it to our IV finished package.

3- what kind of visa they will issue on my passport is it K3 or Cr1 or there is no difference between both

thanks in advance for any help

The petitioner (the US citizen) has to fill one of those in even if he/she is not eligible to be a sponsor.

A K-3 visa is a non-immigrant visa, a CR1 is an immigrant visa. You get the visa you applied for. I think an I-130 petition is supposed to ultimately result in the immigrant visa, though I could be wrong. If I am I'm sure people will jump in and correct me.

There is a HUGE difference between the two visas. With a K-3 you have to get permission to work and you have to adjust your status once in the United States, which takes more time and costs more money. With a the IR1/CR1 (unconditional and conditional, respectively) you may work immediately and do not have to adjust status, though you have to remove conditions after 2 years with a CR1. The IR1/CR1 visa is supposed to take longer to process, but I think it's by far the better choice.

Thanks Homesick

you said that the US citizen ( my wife ) has to fill form I-864, even if she is not eligible to sponsor me which is true because she is not employed, but her US aunt who is a Policewoman in Chicago Police Department, will sponsor me, So, you suggest that i can get all information needed for I-864 form from her and fill it up .

1- But what about the notarization, i think such a document should be notarized from the US

2- the Embassy in saudi arabia asked me to bring them a photocopies of W-2, tax return and a letter of employer from our sponsor,is that means she ( my wife's aunt) could send such a documents via e-mail so we can print it out here and staple it to the whole finished package of my Immigration Visa, i hope so

3- Do you have any idea about when they issue a case number for some one's immigration process

till now they didn't give me a number for my case

4- You said CR-1 visa takes time more than K-3 visa, How many months, years you're talking about

5- Could any one direct me to the right place where i can find a Flowchart for cases similar for mine i.e. DCF from US embassy overseas for some one who has a legitimate residency at the same country where that US embassy resides.

thanks alot,
