My company applied eb3 for me in 2015 as a nurse. My I-140 was approved in May 2017. However, uscis hasn't mailed us the acceptance package or the case number so I can proceed with my case. Last December, my attorney already filed an I-824 (application for duplicate approval notice). Also, he has emailed NVC several times since then. For the past 14 months, I also emailed and called USCIS and National Visa center multiple times. USCIS said it should have already been sent to NVC. But, NVC said that they haven't' received my case. 

 

What should I do other than continue to wait? 

Can I apply for a F-1 student visa and study in the US while I wait for my case? Or would I be rejected because I already have an approved I-140 on record?

What does it say on the USCIS website? It should list your status as "Sent to DOS"

It has been showing the same thing since last May

 

"On May xx, 2017, we approved your Form I-140, Immigrant Petition for Alien Worker, Receipt Number xxxx. We will mail your approval notice. Please follow the instructions in the notice  "
