My husband attended his visa interview in Juarez 12/2017. He was denied a visa because during his medical exam he admitted to using marijuana 8/2017. His visa refusal letter cited  212(a)(1)(A)(iv) and  212(a)(9)(B)(i)(II). However, he was instructed to come back to the medical clinic 8/2018 to demonstrate drug remission. The medical clinic also provided info about drug abstinence and coming back after 9 months.

 

He was told his approved I601A was revoked.

We previously had counsel throughout the entire process - this attorney told us we would NOT need to submit an I601.

It seems to me that we DO need to submit the I601 (because the provisional waiver was revoked and he got the 10 year ban). If this is the case, do we need to wait until the next medical examination or can we submit it now?
