Timeline

used to be able to ph directly, cant anymore. the only thing you can do is request your records, wont help this process but might give some insight.

after some time you might get your senators/congressman involved and they can request an update, usually still pending but you could get lucky.

the writ of mandamus is something to consider for those who are really out of the loop and geting no where... however check the other FBI thread and google it to see what is happening with this.

might take awhile but there is alot of info on the FBI namecheck phase in there just really have to go through it all, or at least the last 20 odd pages.

if you are talking about AOS namecheck, everyone goes through and get stuck to varying degrees. If you are talking about overseas, no, not everyone goes through a security clearance prior to visa issuance.

yes over seas , our case from 2005 , petition I-130 and we call uscis and they told us that we need to wait for 6 months because the case at FBI name check ,my wife live with me in my own home country

we are really stuck , and latey on march we filed for k3 and we still waiting do not know what to do

you still may be in the wrong forum and will continue to get inaccurate advice should you keep questioning here. did you file DCF then? directly at the consulate? or did your file go through the sevice centers here 1st.

depending on what country you are from you may be in security clearance vs. namecheck. namecheck = stateside.

yes we applied for i-130 on 2005 and thenthey told us the case will take 999 days so we decide to live together untill the time arrives and we called this year and teh told us the case check name and then we filed for k3 and we are waiting , it's really out of normal time so we do not know what to do

some real good advice please

where are you filing from?

i am no expert at all in filing over seas, and dont know if i can really suggest anything because i may miss an important aspect. i believe you should be postin in the waivers, 221(g) forum OR in the Regional forum of North Africa/Middle East.

1. do you have a co-sponsor? if not how is your wife establishing domicile?

2. when was your interview?
