Hi everyone,

 

We are about to submit our paper work to get green card IR1 visa for me.

I just wonder whether my passport will be hold by USCIS or embassy during the process.

If they keep my passport for months, how can I travel to visit him during that time.

 

Background information:

My husband is US citizen. I am German citizen, live now in UK. We're marriaged over 5 years, and live the whole time in Europe. We are moving back to the USA, as he first had found new job. I'll join him hopefully soon, after I receive my green card.

He will submit the forms and documents from the US very soon.

 

Is there anyone in the same situation?

Your passport will only be taken by the Consulate at the end of a successful interview, in order to place the visa paperwork in it.. usually 1 to 2 weeks... occasionally they request the passport then and there is an unexpected delay for processing... my understanding is that you can request it back if you have to travel, and then take it back to them after.. others may help here...

As mentioned above, they will only take your passport at the interview...if you're filing now, the interview will be in about 10-12 months, possibly longer. Do you have a tourist visa to the U.S.? If not, I suggest applying for that first before you file for the spousal visa. It might be harder to get once you're in the system.

Thanks. I don't need a visa to travel to the USA, as I am German citizen.
