Obama health care mandate and Affadavit of Support

My sister is considering sponsering my wife but is afraid my wife will potetnionally not meet obamare health mandate rules and she will be charged for months uninsured. She paid 1500$ a month for her daugheter in law that did not have insurance for 2 months simply because she paid 50% of her expenses for over 6 months. Anyone know if this would affect her. My own of the fly answer is no but would like confirmation.

You should get your wife healthcare or there will be a fee for the months she is without healthcare.

Someone else can correct me if I'm wrong but your sister "sponsoring" your wife won't mean that your sister automatically gets the bill.

 

If your wife doesn't carry health insurance and she incurs a fine it will go to her. The affidavit of support from a secondary party is just saying that if the immigrant themselves (or the immigrant and his/her spouse) isn't able to financial support themselves, then this other person will step in.

 

So it will be on you and your wife to pay those fees. I guess if you really were deliquent eventually they may go after your sister.

Your sister is under no obligation to pay for your wife's healthcare costs. Your sister, if co-sponsoring your wife will be responsible for the affidavit of support. That being said everyone living in the US must obtain health insurance or pay a penalty in tax. That is incurred towards your wife, and I presume, you if you are filing married-filing-jointly. As her husband you should look to try to obtain health insurance for your wife to ensure that she is taken care of. The clock starts ticking once she arrives stateside. There is only a small grace period.

 

You may purchase a plan privately, add her to your own plan, sign up for Obamacare, or obtain health insurance through a job if she is getting one. If you are bringing your wife to the US, you need to think about what to do about health insurance as soon as possible.

 

Btw, your sister is also not responsible for paying for her DiL's health insurance either, although it's kind of her... $1500 a month for one person sounds like a premium plan, perhaps she should downgrade to something on a lower tier.
