Hi, I have posted these questions before, but I didn't receive any comments. I'm trying again. Thank you in advance for stopping by.

 

we are going to file an AOS for me soon. Husband is USC. I've been working on H1B on term contract. H1B to GC through marriage.

 

1. Husband is going to school using VA benefit, and does receive BAH (Basic Allowance for Housing), which counts as an income. Is this right? He has post-9/11 benefit. 

 

2. Assuming that his BAH count as an income, that's still not enough income, so we are trying to fill the gap. We can't use my income, even though I make good amount of money, because my contract is annual. We do have some savings, so currently planing to use assets. Does it matter whose accounts we have the assets in? All accounts are US accounts, but we have his, my and our joint accounts, but most money is in my personal account (US). 

 

3. I read somewhere that, when using assets to qualify, you should be "comfortably" over the x3 (in case of spouse petition) the gap between your income and the poverty line. We highly prefer not asking someone to be a co-sponsor. How "comfortably" should we be above the x3? Our gap is about $6000, so we plan to save $18000, but that's minimum. How much would you call "comfortably above" in this case? Do you think $20000 could work? I know at the end it'll be up to whoever making the decision, but we want to hear opinions from people who have similar experiences.

(Employer filed H1B extension before I filed AOS with spouse)

4/4/2018: AOS package (I-130, I-485, AP & EAD) sent

4/6/2018: at 5:00 arrived at Chicago office

4/15/2018: Sunday at 22:30, received email/text notification

4/19/2018: NOA (I-130, I-485, AP&EAD) arrived in mail

4/20/2018: Biometrics app letter arrived in mail

5/4/2018: Biometrics done 

5/7/2018 (p.m.): I-485 and I-765 Status changed to "Fingerprint Review Was Completed"

5/9/2018 (p.m.): I-485 status changed to "Case is Ready to Be Scheduled for An Interview"

8/20/2018 (p.m.): I-765 status changed to "New Card Is Being Produced" 

8/24/2018: Received combo card in mail

11/13/2018: Online status says "Interview was scheduled"

11/19/2018: Interview notice in mail

12/03/2018: Online status changed back to "Case is Ready to Be Scheduled for An Interview" once again, I freaked out

12/18/2018: Attended the interview, approved on spot, status changed to "Card is being produced" within an hour

12/21/2018: "Card was mailed to me"

 

H1B extension (employer) at the same time as marriage-based AOS

3/23/2018: "Case Was Received"

10/16/2018: Approval letter arrives at the employer's office, online status still not updated
