My fiancé is Canadian, and he is currently working in Switzerland; his position there will wrap up in August, at which point he will probably move back to Canada. I currently live in the US and have no plans to move during this time. These are a few questions from my fiancé about applying for the K1 visa:

1) Can I interview in a country and receive my visa in a country that is not my place of residence when my fiancée first files her petition?  How do I indicate that I want to interview in Canada even though I currently live in Switzerland?  My work visa in Switzerland expires in August and I must leave the country before then, and I plan to go back to Canada.  The G-325A form has me list my current residence, so I must list 'Switzerland', but I will not be able to interview in Switzerland.

2) How long does it usually take for them to approve a petition? And how soon do I need to go in for the interview once the petition is approved?

3) How long does it take between the interview and being awarded the visa?  (i.e. how long do I surrender my passport?)

4) Can we cancel at any point before the interview?  There is a chance that while the petition is being processed, I will receive a one-year position in Ireland or Canada.  In that case, we would marry while I am abroad and then I will enter the States the next year.  What complications does this fact suggest?

 

5) Can I enter the USA as a visitor during the period when the petition is being processed?

6) Finally, given this is our situation, should we consider hiring a lawyer? Some of these things seem a bit complicated, but we’d love to save the money if possible.
