Hello all, 

 

My wife has her H-1B visa and we are not planning to travel while her green card application is being processed. 

 

Given the above, is it correct to say that she does not need to file her form I-131 (Application for Travel Document)? 

 

This is what I am able to glean from trying to read between the lines, but I cannot find a definitive yes/no answer. Would appreciate any insight.

Day 0: 2017/02/04 - Application filed for wife (I-485, I-130, I-765 and supporting documents); sent to Chicago Lockbox

Day 17: 2017/02/21 - AOS NOA1

Day 46: 2017/03/22 - Successful Biometrics appointment 

Day 87: 2017/05/02 - EAD approved

Day 98: 2017/05/13 - EAD received

Timeline

Applying for advance parole (i131) is optional, if that's what you're asking.

If it isn't difficult, it isn't worth it.

11/2/15: NOA2

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

Timeline

However, it is in most cases recommended to do so. There are many sad stories of unexpected reasons to travel abroad (usually related to acute close family health issues), and having to chose between missing a last goodbye/funeral and abandoning AOS. But, if your wife is allowed to continue to travel under her current status (I'm personally not familiar), I guess it's redundant.

If it isn't difficult, it isn't worth it.

Indeed - I think she is in the clear though, since she is on an H-1B visa, and according to the I-131 instructions (see image below) she does not need to have an Advanced Parole while on H-1B.
