Hello Everyone,

On Feb.20,2015 I sent my N-400 Application based on 3 years marriage and on June,2015 I had my interview, the officer asked many questions and she wasn't friendly and at the end of the interview she asked for my first marriage certificate and she said send it by mail and you will receive my decision by mail ,i sent it in the same day and waited like 6 months to hear back from them but nothing than i sent info request than they sent me another request my divorce certificate even i submitted a copy before and than i sent the original one with extended translation and wait to hear back from them but nothing till April,2016 i sent info request they answer me saying I'm in security check and on August,2016 i went to Congressman office which is not helpful at all because she just sent info request and I'm still waiting but should i wait forever???? I'm city employee since i came to USA and never arrested or do anything against the law here in america or in my country and i live with my husband and our kids and we are happy family . I,m really very frustrated .....anyone pass with the same situation please share.

Some people face the same situation. You've waited a very long time.

The best your congressman can do is contact USCIS and ask what's going on.

You should also contact the USCIS Ombudsman and both your Senators. Give them a little time to see if they can get an answer from USCIS.

Finally, you can take USCIS to court and force a decision on your case. This may be expensive and will take time, but you should understand that USCIS is required by law to reach a decision on your case within 120 days of your interview. That means that USCIS has been in violation of the law (not of USCIS regulations) since October 2015. A judge can either order them to reach a decision or can ask for your file and make a decision himself. This procedure is referred to as filing a "writ of mandamus" and is probably the step you should take next. However, before that, you should contact USCIS again (make an infopass, contact the Ombudsman) and write to your senators and explain your intent to go to court.

For your information, USCIS will say that they have no control over the length of the background check, however, that is not your problem. The law makes no exception for prolonged background checks. They have 120 days to make a decision whether it's approval or denial... if they can't complete the background check by then, then they have to reach a decision without the background check.

If you don't have an immigration lawyer, it might be time to start looking for one; make sure it is one who can show you that he has filed such cases against USCIS in the past and won.
