K1-K2 Visa

I received MOA2 today for my fiancé in my home country Romania. My fiancé has an 11 year old child who will we going to the interview to solicit a K2 visa, however my fiancé was never married... does she need to show anything at the interview that even though she has a daughter, she was never married? Maybe a civil document ?

If never married, I do not think you need anything to prove that you were never married.You may need a letter from the biological father, though, stating that he gives permission for his daughter to leave the country and live in the US with the mother. You can find sample letters here in VJ.

If the child is travelling with one of their parents, they must show written consent (certified by a notary) from the other parent allowing them to leave the country. This consent is not necessary if the accompanying parent can prove:

• that custody of the minor was granted by a court
  
• that the other parent is deceased
  
• that the other parent has been declared as missing or their parental rights have been revoked
  

I believe that certificate of free to marry is required in her case.

We received notarized letter from that father of that child stating that he gives permission for the child to reside permanently in the USA. Him and my fiancé never been married so she caries her maiden name. Just the child had the fathers last name. I am applying for my filipina fiance working in Singapore, She have one 12 years old son and she was never been married. She got a cenomar, certificate of no marriage that she will need at the interview as she was told one of her friends who previously applied for K1 visa.

I would think you might want to check on this if required in Romania as. Why take a chance if you can have one available...I know some VJ organizers might agree or disagree with this, but that is their problem, they are not applying on your behalf and nothing for them to loose. It's your case and it up to you to protect it and get it approved even if you present documents that are needed.

I do not think so. I am in the same boat with my wife where she never married but she had kids from 3 different men and all the kids have different last names ... as long as you have their birth certificates with their proper names and show that your maiden name is on the birth certificate, I do not see why you need a document to state that you were never married. We got approved and we have our interview next month.

I also went the K-1 route (wife came over first, sent for kids later[current process]), and we did not have to present anything regarding any marriage, she was asked about it at the interview and she stated she was never married. We were approved. If it is a Romania requirement, then you should get one of those certificates, but in general, it is not mandatory.
