K1 AoS I-864 supporting documents

Timeline

My husband and his mum are both sponsoring me because he doesn't earn all that much but his mum does

they've both filled out an affidavit of support for me and we assumed all we needed were copies of their tax returns, as that's all they ask for in the forms.

ive just been reading various posts on the forums and other people have huge lists of various income proofs they have sent off with the I-864, im now worried, do i need more proof?

This is a numbers game. If you satisfy the qualifying criteria with what you are sending in. i.e. W2s from your husband and his mum exceed the qualifying condition then you need not over subscribe. Just send in the evidence needed to satisfy the condition. When I filed for AOS I submitted my wife's w2 along with proof of savings; since we did not qualify on income alone. Try not to sweat it :)

Thank you, i just get myself into a panic over everything lol i think we're all sorted now his mum has a very very high paid job so we've not had a problem so far, im just too much of a worrier i think haha

A tax return is the only required proof. That means complete tax return with w2s or 1099s (wage statements that come from employers)-OR- a tax transcript. The instructions say you may send optional proofs or the two previous tax returns if the additional information helps your case. And you are required to prove Mom (joint sponsor) is a USC or permanent resident.

By submitting the complete tax returns you have done what they asked.

Proof of current income and past years' tax return(s) are two separate things. What matters for Affidavit of Support is current income, and that needs to be proven with pay stubs, and/or an employer letter. Past years' tax return(s) don't prove current income; they say what was the income in that period in the past. The form requires you to provide the last year of tax returns and the last 3 years of "total income" numbers but they are separate from the proof of current income.

Part 6. Sponsors Employment and Income

Item Number 2. Current Individual Annual Income. Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided.

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employers address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income.
