Hello Everyone.

I'm filling out I-864 and have several questions.

1. I have filed a tax return for only 2014 and 2013. I didn't file for 2012 since my income was less than $5000.

Am I supposed to check box 20 "I was not required to file a Federal income tax return as my income was below the IRS required level"?

2. Do I have to fill out Part.7 since my income for 2012 is below the IRS required level, even though my current and most recent tax year (2014) income is a lot above the IRS required level?

Thank you!

They are mostly concerned about your current income. If it exceeds the guideline amount you are not required to fill out part 7. It's optional. But if you think it will be beneficial to you, you can. Mostly they will look at your most recent tax transcript and your letter of employment.

For 2012 I would list your income in the box, provide proof, and a letter explainig you weren't required to file that year. I'm not sure if you check the box. I'm going to say no. Don't check the box.
