Hello everyone,

I have a quick question. I found that My EX wife didn't fill my tax refund for 3 years and I am filling the N400 form for Citizenship.

I contacted the IRS, filed out all the years that were not filed and made a payment arrangement with them.

My question is: should I answer " yes " or "No" for the question " If you have ever failed to file an income tax return since you became a Permanent Resident"?

Any answer will be appreciated

So you filed. Say "No" on the form.

Thank you edt370a for your answer. I was just wondering if I have to answer "Yes" because I failed to file tax on time even if I filled later.

No. My husband never knew he had to file city taxes for many years, and finally filed five returns at once along with penalties and so on. His lawyer told him to say No. It never even came up at his interview and he got citizenship without any issues. Also, you can go to Avvo and see how many people have asked this question and been told to answer No.

Answer No to that question.

But depending on what your "payment arrangement" is you may have to answer

Yes. To question 6. Do you owe any overdue, Federal, State or local taxes?

So that's my question to you, did you pay your taxes, penalties and interest in full, meaning you have a zero balance or did you setup a payment plan with the IRS, where they take monthly payments until the taxes are paid off?
