DCF - Do we qualify?

Hi all,

I've been a long time reader and infrequent poster on this forum and find your notes invaluable. I just wanted your thoughts on the following:

Me - UK Citizen married US spouse while on J-1 in Nov-14.

Returned back to UK in late March 2015 (in line with requirements of Visa)

Spouse accompanied on UK Spousal visa (Spouse / CP)

  • What is typically the most efficient method to return to the US - from reading this forum it looks like the CR1 route via DCF - is that accurate?
  • Will I be unable to apply until a minimum of 6 months has passed? (I read this on the forum so just wanted to check against my fact pattern above)?
  • Do people in our situation normally hire an immigration lawyer or handle the situation themselves?

Understand the above is all a little vague but appreciate any steer you may be able to give.

The USC needs to have lived in UK at least 6 months to qualify, so you can either wait till the 6 months and do DCF or you can apply for the CR1 visa now.

You can do it yourself, we had a lawyer who messed ours up and wish we did it all ourself with the help of forums etc!!

This is no longer true. They removed that late last year.

You don't need a lawyer, unless you have some weird situation.

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

When we do get through the GC process are we required to go back to the states within a certain timeframe? I assume yes - but have not seen anything specific.

You'll need to use the visa before it expires, is all (generally they expire 6 months from the date of the medical).
