Hi.

I came to the US since August 19, 2014 as a B2 Visitor/Tourist visa holder. I got married January 13, 2015 with a person I met since October last year and fell in love with.

I'm planning to send I-130, AOS, the EAD and the AP but I'm Admit Until February 18, 2015 (six months expires) tomorrow. I can't send the documents before that because of her W2 or the Tax Returns didn't came yet. USPS is delaying mail from where her mom sent those documents and now I'm in this situations.

Is there any problem if I send this AOS, etc after my approved 6 months stay expires?

Am I going to have a problem while applying for the advance parole which I really need to travel to my country before the Green Card comes?

I guess I'll be able to send all the papers a week after my admission expires but I'll be out of status....

DAY 19 - March 21, 2015: NOA for Biometrics Appointment scheduled on 04/01/2015

DAY 77 - May 19, 2015: EAD and AP has been approved "We ordered your new card"

DAY 84 - May 26, 2015: We mailed your EAD to the address you gave us/USPS picked up the Card

DAY 85 - May 27, 2015: Interview Scheduled for June 29, 2015.

** May 29: Traveled with my AP back to my country and came back three weeks after with no problems Click here to ready the report **

DAY 117 - June 29, 2015: Had our interview. Approved on the spot.

DAY 124 - July 6, 2015: Welcome noticed received.

DAY 134 - July 16, 2015: Green Card delivered to my home by USPS - END OF AOS -

Hey Friend.

What do you recommend me to do?

Send the papers without the W2s complete? We only have the 2014 W2s without being reported to the IRS.

We are waiting for the 2013, and 2012 W2's to take all three years to the Tax person and report it to IRS. becaause she hasn't did it yet. none of the last three years.

Or better wait til next week and having all the taxes completed and reported to IRS and attach info and send it among all the papers.

I have the employment letter, already. I understand all this is for the Affidavit of Support.

If you file before 4/15/2015 you don't need to worry about the 2014 W-2. You wife must file taxes for the past years. She won't be able to sponsor you without her tax situation being current. If she is planning to file her taxes by next week, I'd say wait until taht is done so you can send in 2014 taxes as well.
