help about application I751

Hi All,

I am in a little bit difficult situation. My wife (citizen) and I have been good and she applied conditional green card for me. But now our marriage has problem and she only signed the I751, but in the future, if there is an interview, she refused to come with me. I was wondering what the chance of the interview is. If she refused to come, will I be able to reapply if we divorce after that? Besides, if I got rejected, will I be able to apply NIW or EB green card..etc in the future? Thank you so much!

For my materials, I have:

1 joint condo, 1 joint house.

2 recommendation letters from friends

2 joint cars

3 joints bank accounts

both driver licenses showing living in the current address

plane tickets to other country

photos

Is it enough?

Send your joint tax transcripts from the last 2 years.

Do you have health insurance?

Wills?

Joint credit cards?

I cannot predict the likelihood of an RFE and an interview. However the vast majority of people who entered into their marriages in good faith, with spouses, who also in good faith signed their ROC application form, have little to no trouble being approved.

If you should divorce before either an RFE or an interview occur, I think you would need to refile under the appropriate waiver (divorce).

Remember, the ROC process is not to test whether you marriage lasted. It is a test of a marriage entered into in good faith with reasonable good faith efforts by both parties (living together, having joint assets, insuring each other, etc.)

Yes, joint credit card. but no joint health insurance. we may not divorce too soon since it takes time. she still live with me.
