For a K2 visa, the son's K2 visa must be issued within 1 year of the issuance of his father's K1 visa. Plan to submit a visa application for him accordingly.

If you're looking longer term than that, but before you fiance becomes a US citizen, you will want to submit an I-130 petition for the boy as your stepson.

I should have asked first - how old is the lad?

oh he is 7

so what form do we fill out for the K2 Visa.

The same forms that your fiance fills out for his K1 visa. Some of the required supporting documentation will not be age appropriate. The instructions that come from the consulate in the visa application packet should tell your fiance.

If the boy will want to follow within 6 months of his father, recognize that the visa will be valid for 6 months. It's usually easier for parent and child to apply together than to have a child apply separately later on.

thanks for your timely response..i have one more question..

we are thinking about not filing this way for his son since he is in school in barbados

how does the whole green card process work...when his dad gets his....will he automatically get his since he is listed on the form...and is under 21..

i know this works with the citizen ship application but i am not sure if its the same with the green card application

The boy will have to submit his own application to adjust status, and to do that he will have to be in the USA and eligible to adjust status. He does not become a LPR just because his father has become an LPR.

He will not automatically get citizenship when his father does if he isn't a LPR.
