Hi there, I am Timi from Kosovo, my Priority date is Oct.18.2002 under F4 Category.
I got married on August of this year and my question is: does my wife has the rights automatically to be added to this category or there is a form that need to be completed so this can be done.
Please let me know

Are you the principal beneficiary? If so, then yes. Your wife can be added automatically to the case. However, this is done when your case is at the NVC. There is no form to fill out to add her to the case, you just have to let them know and then she would submit the same paperwork that you have to submit. If you are a derivate beneficiary however, you would lose your place in the case.

Thanks for the help, but I had a question, my case was sent by USCIS to NVC in 2009 when I was still single, which means that NVC has no information that I recently married , now what should I do at this stage , I must notify the NVC or how to act, this I have not clear whether i should notify NVC

Like I said in my previous post, you have to notify the NVC. They will add your spouse to the case and she will need to pay the IV fee, fill out the DS260, and submit her civil docs (including the marriage cert). You will also need an updated affidavit of support from the petitioner that includes her. Will your PD be current soon?

Not soon, at least 1 year from now

Ok, I see. You can email the NVC or call them (it would be better to call first) and tell them that you have a spouse that you need to add to your case and they can then invoice you for her IV fees. Then you can submit the additional paperwork. Remember that you will need an updated I-864 from the petitioner, and joint sponsor if you are using one. What I don't know is if you would need that new I-864 now or later, but you can ask when you contact them.
