Form I-765 needed for F-1 student already on OPT?

I'm new to this forum so please forgive me if this question has been asked and if so, please direct me to the appropriate post.


I'm married to my husband who is a US citizen.We have known each other for more than 3 years before we got married on August 1, 2014. Our marriage is bona fide.


I have a question to whether or not filing the I-765 form and how. I'm currently working using my OPT employment authorization which will expires on January 21, 2015. Should I file the I-765 together with the I-130 and I-485 since I may not get the green card before my OPT expires? I do not want to stop working while waiting for the green card to be approved. If I can file the I-765, should I check the box that says "Permission to accept employment" or " Renewal of my permission to accept employment"? And should I put c9 for question number 16?.

I'm in the same situation. I applied for a new EAD just in case my AOS takes longer than normal so that I can keep on working once my OPT EAD expires. Mine expires February 2015, so everything should be done by then, but you never know what can happen with your application.

You will select permission to accept employment, C9.

12/13/18: File online application

12/15/18: Receive notification for biometrics appointment (no date)

12/31/18: Biometrics

02/25/19: Receive interview letter (April 8 )

04/08/19: Interview, approved!

04/12/19: Oath scheduled for April 26

Thanks for your response. I really appreciate it. Can I ask you if you needed to send copies of all your I-20s? I know that I had to send them for my previous EADs because they were for OPT. I'm not sure if it also applies in this situation.

I can't remember now if I read it somewhere, or if I just wanted to be (overly) thorough, but I did send copies of my I-20's. It is probably only necessary when you apply for an OPT EAD, but I would rather send extra than getting an RFE.

You have to send copies of the front and back of your EAD though, but you probably know that :)
